the plague

ok this is the story..... based on facts and i have screenshots to back up all my claims
ok i was in my shuttle watching a capital fight in kerham a few days ago when an absoulutuion warped to me then blew up my shuttle no big issues i though i will get out in my nice expensive pod... the problem lyes where i didnt actually get to see my pod due to lag my screen locked up and the next thing i know 20 odd seconds later i was in a clone station...!
so i petition....(well you would wouldnt you)
this was the reply "hi the plague: After checking our server logs, we found no server issues at the time of your ship's destruction. This is not to say that you did not experience lag, however, it means that the source of the lag did not originate from EVE server. We regret the loss of your pod, however, in this case we will not be reimbursing your pod. Thank you for your patience and understanding. "
ok not happy with this i reply... this is the response i get "Hi,
We are not denying that there were some server issues, but unfortunately, we are unable to verify them using our server logs. Our reimbursement policy states that we must be able to verify that losses are caused exclusively by server issues before we can reimburse any losses.
Please understand that we are not disputing your recollection of events, but our reimbursement policy is very strict, and we must abide by it at all times. We hope you understand our position."
did he just admit server issues?????? i think he did.. so i point this out
he replys " I believe you misunderstood.
Our logs do not show any indication of any major server issues at that particular time - Yet we do not deny that it is possible that you had connection problems with the server at that moment. It is however impossible for us to verify that."
did i missunderstand i didnt think so so i quote him and he once again replys as follows
" What I meant was, there we cannot deny the possibility of server issues. However, our reimbursement policy states that we cannot under any circumstances reimburse losses unless we can verify them using our logs. In this case, we have been unable to do so.
oh well i got bored of this i was getting nowhere fast all i keep hearing is bla bla bla bla bla
what do you guys think?

you have to think of GMs as real life insurance business. They'll do anything to avoid paying

I think that if you expect to sit in the middle of a capital-size fleet engagement, with all the lag it entails, you had it coming.
I can see how the whole server issue thing puts things in a new perspective - but that having been said, I do hope that it is a case of CCP employing a new and more ruthless policy on reimbursing lag-related losses.
After all, as they clearly state, their records has now way of showing the state of lag you are in, which could also likely be hardware-related.
Put shortly: CCP has been reimbursing generously on account of 'server problems' - and more importantly, spent valuable time going through circumstances - generously, and it simply has got to stop. I know for a fact that it has already become close to 'corp policy' to petition upon the loss of a capital, which causes considerable strain on the petition system.
I am sympathetic to your loss. It must be very frustrating. But - again - if you're carrying anything expensive, don't hang around for anything to kill you...

They replied that they couldn't find any problems with the server, but in order to avoid telling a customer they're flat out wrong, they added "but we might be wrong". They then go on to tell you that they're only allowed to reimburse ships that they can prove were due to server issues.
Now, onto the event itself, ccp are correct that the lag wasn't caused by their server, it was caused by your computer stuttering due to the large amount of information it needs to process when your ship explodes. In future, when you know your ship is about to explode, select a planet and begin clicking "warp to" as fast as you can. This will make the lag work for you. As you click, your lag will make the server receive the warp to command a short time after you click it, spam it enough and you'll have enough overlap that the server will process a warp to command the instant your pod appears (and thus isn't scrambled)

Why do you waste the time of GM's for such a crap???
You lost your clone? So what!
If it had expensive implants it is your own fault! Everyone knows that fleet battles are laggy, so going there in a clone with expensive implants is all your own fault. You should have used a clean jump clone. And if you have used a clean clone then why do you bother?!

My impression is that the lag when one gets a ship blown up is mostly graphical lag.
Ie lag caused by a combination of you not having unreasonably fast graphics hardware, and some ****ty coding which which lets your system freeze for a few moments.
Thus not server lag, thus no reimbursment.

If you feel the GMs response was incorrect or you did not receive proper service, request for the petition to be escalated to the Senior GM queue. They will review the petition and respond appropriately.
Locking the topic, question asked, proper course of action given.
