Emo does not simply mean emotional or sad. Its a subgenre of punk rock. Trivium, although a 3rd rate band, is definatly thrash metal or metalcore. Much like Bullet for my Valentine, they are not even remotly emo even though they have overly dramatic lyrics.
If your definition emo is simply songs that are sad, then damn near every artist who ever sang is emo. Phil Collins, the Cure, Backstreet Boys, Metallica, Ray Charles, and all of country music would all be a bunch of emos according to that definition.
As I've said before, emo hate is now more cliche than emo. People are so intent on blindly hating emo, that they start calling anything crappy emo without actually knowing what emo is. Emo still sucks though.

Does it matter what it is? No group of people has ever agreed on what cathegory some bands are in and emo (even if you hate it) is just another cathegory.
Hell, this "I hate emo" culture is even more whiny than emo itself, its sad really.

similarly not every song with too much emotion and too few chords is emo.
