During a mining op we had this dude stealing ore and goading us into hit and run fights. I was in my Maelstrom when he warped in flashing red so i sicked my medium scout drones on him and got concorded. WTF!??!! Another member in my corp was concorded for firing at him with autocannons while he was flashing red.
Ok so either it was a game bug or this dude found a way to exploit the game in some way. Take your pick cause i dont know.
So i sent in a petition and was met with this response:
"Thank you for contacting customer support, we apologize for the late reply. We checked our logs but regret to inform you that we are unable to verify your loss in our logs as being abnormal in anyway. Because of this we are unfortunately unable to reimburse your ship. We apologize for the inconvenience this has caused you and wish you a speedy recovery.
Best Regards, GM DuoDuo EVE Online Customer Support"
I escalated it but was met with the same B.S. I received the very same dear john reply from another lazy GM. I know darn good and well that if there flashing red i have kill rights so i DID NOT deserve to lose my battleship with all the T2 gear on it and rigs. I had alot of money wrapped up in this ship. If it was truly my fault there would have been no foul.
Personally i dont care what your BUGGY system says about the incident! I am in the right as was another member of my corp!!! You GM's need to get off your lazy asses and get it sorted out post haste!! As for me....i have had enough of all the bugs, server crashing, lazy GM's and exploits. I have canceled my account, CCP will never again get my 15 a month especially if this is how you treat a paying customer who was in the right. Tip to CCP: hire some GM's who are there to help instead of hinder....

Not true. I had a similar incident during a mining operation and was concorded just as this person was. I sent in a petition and was reimbursed everything as if it never happened. I am quite pleased with my service here and although the server is crashing on an almost daily basis I feel quite sure they will remedy the issues before them. As for your non reimburseal I can only derive that you actually did not have kill rights and therefore were dealt with appropriately.
People, in the heat of battle the mind races and things like small important details are, more often than not, overlooked. Please be certain of your rights even though you may think you have them. There are numerous different scenarios when a player is flashing red and you cannt fire on them without being paid a visit from concord.

so not true, i had the kill rights or he would not have been flashing red. a red flashing players stands out on the overview no? anyway i know for a fact that he was flashing red and perhaps he found a way to make it appear as he was flashing when he was not....an exploit.
trust me he was flashing red before i targeted him.

Erm, if his sec status was just under -4.99, he will flash red because of sec status being rounded up(down?) to -5....(unluckily, Concord sees it as someone attacking another player) It has been known for some people to exploit this, but CCP do nothing about it ---

I've tried the excact same. CCP didn't want to accept it and rejected my pention  But I agree to you, if CCP don't start getting things right, the next month will probely be the last I buy. Ever.

I've lost Billions of isk due to bugs. CCP just says doesnt show anything in our logs when i petition...
I've lost faith in them and stopped petitioning.....the petition became a joke to me..
Best you can do is to accept that EVE is a buggy game and live with it...

If you felt you lost a ship due to a bug ask for it to be looked at by a Senior GM. Posting the response of a GM will not solve anything, besides getting this post locked since its against the rules to quote a GM's response.
But given the way you act, I will just say, I am going to bet you missed something. If you can't even tell us the person's security status then how can you describe the situation in more detail to a GM?

lol the server sucks cant count how many times i have had to restart angel extravaganza cause of crashing.
to the fellow 2 posts up.... um what?
sorry but i was there and i know what happened and im no newb and used to combat in this fashion. personally i dont care if this post gets locked or not. the damage was done looking at all the viewers who have read this already.
and whats the big deal about quoting a automated response? i was given this same response 3 times already.... the very same one. anyone who has had any trouble with them knows this one by heart by now.

Woah that was the response to you? I have the same response when my Raven got pwnd during multiple dictor bubble launch from pirate gang. when the 4th dictor bubble was launched infront of me. My client crashed. That was the same email that was replied to me. Infact i should have not lost my Raven cause i was cloaked and almost near the jumping range of a gate. if only it didnt crash =(
Oh well... i wonder how they check if there is abnormality or what? Since Rev II there are abnormalities in the server.

Well, We've lost yet another corpie and i'm getting fed up now.
CCP please understand that pressing a tickbox to send an automated reply, without reading the issues sent through the petition system is very annoying for the community.
You have the petition system for us to supply you with feedback. A Mod to review it and come back with a decent answer. I'll admit that most of the time I have had positive experiences.. altho someimes it takes me a while to force the mods to read it properly 3-4 times which is frustrating.
It feels as tho you have a small team of people that unfortunately have a lot of responses to deal with.. and therefore theyre just getting through these as quickly as possible to "make the numbers". If a player has chosen to provide you with feedback please take a reasonable amount of time reviewing, as it took us the community a reasonable amount of time to compose it.

I've had the opposite response, I lost a ship, and went on about my business, bought a new one and fitted it out, and while fitting it I spotted a bug relating to cap use.
I reported the bug, including all the information about how I had spotted the problem, and the cure for it, and included the message "I do not want the old ship back"... but they did gave it me back anyway, because it's their policy when they confirm a fault.
The fact I now have two of the ships with the same fittings, and a slightly slimmer wallet is just a bi-product.
But be patient, if you have a screen shot of the target as red flashy, or details if you were at war with them, or possibly the person was red flashing, but with a few seconds of their 15 minutes of theft time left, they warped in, hoping that you engage just as they stop flashing... and voila, you get Concorded.
Also, if you joined the gang of someone who had been stolen from, so as they already have kill rights out, you will see the red flashy, but as you joined their gang you don't have direct kill rights.
In short, there's a lot of variables, without your running a log server, and without screenshots of the situation CCP can't act.
My educated guess would be that while you had gone and gotten the battleship the 15 minute timer had drained away, and the*****y thief came back just as it expired, you saw red, and bomb, but not so bomb bomb more splat in your case.
Sorry about your loss, but really, if you give CCP the evidence they require then they do fulfill their policies to the letter, whether that annoys you or not.

I simply don't understand why the GMs didn't reimburse the ship out of good faith. It was obviously a foggy situation, it doesn't cost them or anyone else a cent to press the "respawn ship" button. So why not help a poor guy out?
