You could take these websites offline easily just by flooding their forms with junk using a bot.

Is it the worst scam ever? Depends if you have a Bank Of America account! 
I get tons of these phishing spams. They are getting smarter. In recent ones they've turned off mousover and the bottom bar information with Javascript, so you can't hover and seen the true URL.
The problem is, like the Nigerian 419 scams, they cast there nets really wide and only need to sucker in a tiny percentage to make it worth their while.

generally no. Only case that I do know of is if you manage to trace a hacker down you can contact his/her ISP and they'll delete the account assuming the hacker is actually signed up with that ISP.
