a friend of mine was mining in a belt, (mining drones and lasers) in a 0.9, when someone warped in and killed him, we were not at war, we had no aggro, and had stolen nothing, and concord never spawned to kill the guy, what happened?

Was he jetcan mining?
If so is he 100% sure no one molested with his can?
Very easy to become an ore thief if you aren't paying attention to cans.

no he was hauling it back and forth in his mining ship, the guy just warped in and poped him

Wow, reading comprehension please? I'll save the op from responding, for the THIRD time the guy was moving it back and forth from the station IN HIS MINING SHIP. No jetcans involved.

THERE WAS NO FREAKING CAN!THE GUY WAS MINING THE STUFF INTO THE SHIPS HULL.
WHEN THE HULL WAS FULL THE GUY WAS FLYING BACK TO A STATION TO UNLOAD AND THEN BACK TO THE BELT!
THERE WERE NO CANS IN THIS STORY!

How big was the ship he was mining with, it's possible the guy warped in, suicided him, warped away and concord spawned at his warp out point.

You cannot warp away that fast. Concord is there instantly in a 0.9, and insta-jam you.
Sounds like another exploit to me. I think something like this has been going on for a little while at least, been hearing things like this since rev 2 came out.
