Yes, unless you attack an outstanding player during a transport mission.
Be very careful in using them during missions, I think CCP was supposed to sort out the problem of using them in deadspace missions but you can never be sure.

Hmm, i used them yesterday against drones. hadn't a problem. But ensure there is nothing else (e.g. beacons, gates) in range of them (usally 5000m).

Also, there are certain structures in some missions that aren't maked "Wanted". Hit one of those and CONCORD comes to defend the 'innocent'. If there's nothing near you, and you're absolutly sure that there's nobody anywhere near you (cloaked or otherwise) then enjoy your smarties. Smartbombs will take out your own drones and corpies/gang-mates though.
