what would happen to a miner if, after his can was flipped, the miner targetted and scrambled the pirate but without firing a shot?

Just targetting them wont do a thing, scrambling them however counts as aggression and allows them to fire back.

the only active-moduls which do not count as aggression are passive targeter, ship scanner and cargo scanner (did i miss any?)
simply locking someone is of course not an act of aggression either.
so to answer you question: webbing as well as scrambling counts as aggression, and therefor you will enable the other guy to open fire on you legaly.
im not sure what will happen when you start remote shild repping the ore-thief tho haha. no idea. -------------------------------------------------

Out of morbid curiosity i just had to find out.
Result is that no, shield repping him or armour repping him wont count as agression ............im sure he will thank you for that

So . . . if the miner was to scramble the can flipper and survive intact (ship and all) being shot does that then leave the miner open to being Concorded even tho' the can flipper leaves the scene complete and in one piece also?

No--the pirate was red to u once he stole ur loot but if u had done nothing then he could have done nothing further. Once u fired at him, he could fire back with no retaliation from concord... This continues until the 15 minute countdown ends..after that any continued aggression would involve concord...
So when the pirate left, the aggression timer was likely still going and u could follow OR he could come back in a better ship and try and pod u..

I'm not sure exactly what happens in your hypothetical situation here. Once the miner scrambles the flipper, the flipper is able to open fire on the miner (and likely will). This will probably continue until one or other of the ships is destroyed; and I'm not sure how the flipper would leave the belt in one piece if you have him scrambled and webbed. Anyway, notaway's response sums up the situation nicely - once the miner aggresses the flipper, both parties can fire at each other without CONCORD intervening for 15 minutes. Each shot resets the timer, so if the flipper destroys the miner's ship and the miner keeps coming back and getting destroyed every 10 minutes, this can continue indefinitely. There is one error though, and an important one:

I'm not sure if this is a misunderstanding of the mechanics or just the terminology, but it is not correct. 'Podding' means to destroy someone's capsule once they leave their ship (usually due to the ship being destroyed). Podding is never supported under the aggression system (nor under the kill rights system for that matter). The 15 minutes in which you can freely fire on the other player only applies to actual ships he is in. If you aggress a pod (even just scrambling it), CONCORD will come to show you the error of your ways.
In fact, the only time I can think of that attacking pods is ever allowed is during a war dec.
