If a person is never going to log into an account again and they have given the account to me I'm allowed to use it without any penalty by CCP, right? |

Wrong. Accounts are supposed to be personal. The only 100% legal way to acquire a character is by having a character transfer to your account (costs 20$/Euro/whatever).

Persuade him to come back and pay 20 "monetary units" to transfer the character. How could you manage to do that, no idea.
And why that is like that, again, only CCP knows for sure... we can only guess. My guess is that they hope some day the original owner might return (since characters have NEVER been deleted until now due to inactivity), and by charging 20$ for the transfer, he's more likely to just keep it instead (so he has something to come back to later on if he changes his mind, making it much more likely for him to return in the first place).

Well that sucks... I would really suggest not naming the character in question at all in this discussion. You'll get it banned if you A) have access to it... B) publically admit that you use it or could use it.

Arkarn,
Accounts are not transferable and accessing an account that is not in your name is against the EULA.
The only way you can access the characters on that account is if the original owner transfers them to you via the Account Services page.

thats Please keep it clean,once one my friend transfered char to my account without using forums...he gived it to me and we got both ban...eula violation.and ccp answered us - probably character sale for real money..bla bla

Unfortunately the account is in the name of one person and can not be used by another. The EULA is very clear on this and we can unfortunately make no exceptions. If you wish to query this it would be best to file a petition and let the GM's advise you further.

Since you treat these accounts like property then if the deceased players next of kin gave this player the account you guys are going to stick to your guns?
Somehow I don't think your EULA covers dead people. Have a little charity and at least if the deceased players family wants to give it up let them.

As I have already stated in my previous post, this issue is something that can only be handled by the GM Team. I have advised the player of an appropriate course of action to follow and he will need to let the GM's investigate the case.

If there's actually been a death there should be a lawyer and an executor somewhere and it only takes 10 minutes to ask. Your best bet IMO would be to see if having the executor transfer the characters without buying more game time would conform to the EULA in the lawyer's opinion.
Then have the lawyer write up an opinion on that, have the executor transfer the characters and save the opinion and a copy of the death certificate and certificate of qualification for use in a petition to the GMs should action be taken against you.
It might not fly, but it probably wouldn't cost the estate any extra and wouldn't take up too much of the executor's time so why not? It's a better chance of saving the characters than if the account just lapses anyway. Litigation is of course out of the question unless you're just filthy rich and like going to court; and obviously be prepared to not get upset over it if your petition is rejected. ______________________________

This game is the livelihood of many people, you don't think they have the means to know what you're doing? I've known a number of people that have been banned for sharing accounts. It used to be common practice, but they put a stop to that.
