Again, He's making a website to allow you to sell INGAME ITEMS for INGAME ISK, How does that breach that section of the eula?

I omitted the last part because it was where you were getting caught up on, it's your focus. the fact that there is consent of forming a binding contract outside of the game is my issue with it. --

That said, Yeah, That part should probably be removed.
But even so, That's not breaking any of the parts of the eula you quoted either.

He's not marketing, selling, advertising, promoting, soliciting or otherwise arranging for the exchange of items in the game or other game services ro any out-of-game sales, services or items, It's all for ingame items and ISK.

The part you ommitted is the important part in this case.
The statment from the EULA refering to selling in game things for out of game cash, arranging to sell a something in game using out of game methods is not a problem...otherwise i bet a lot of people would be guilty by using teamspeak/vent/msn messenger....etc etc.
If he was arranging for items to be sold for real world cash then yea, it would be against the EULA

*edit* I read your general terms, I see you are attempting to brush off the EULA as you are merely providing a vehicle for in-game sellers to promote their auctions to other players. Therefore not actually selling the items. How is this different if I coordinate with another player for him to transfer 5 billion isk to my account, and in exchange for this auction i reward him with an eve-mail containing various data describing a ship fitting or layout?

Though I dont have a real incentive to use your site at the moment I will definitely keep my eye on it. Hope it takes off as I can see this being quite the Jita killer if it all works out.
A few questions I have though:
1. Can a corporation as a whole be a seller, or does it have to be an individual?
2. Do you have any safe guards in place to prevent ISK sellers from using this system?
3. Do you have any systems in place to prevent scamming?
4. Have you thought of hooking up with the ingame banks to setup direct isk transfers? I believe Ebank is setting up a system to be, as they put it, a paypal for eve. -------------------------------- To borrow a phrase:

To answer your first question yes you can have a whole corp with an account you would just have to give them the login information
For the second if anyone tries to post a sell order for out of game money i will IP ban them, and chinas government has blocked my webhost from there people so that drops most of them from even seeing the site :)
For your third Scamming is still one of the things where its all on the users because since you buying options are only in-game just make sure you *read* what ever it is you are accepting... and with the feedback option you can tell other people about someone trying to scam :)
For your forth I would love to look into a system like that if you could give me any information you know about that feel free to send it to me.

The thing about the Ebank reminds me of an other site Biggest MMO scam ever
But if anyone ever wanted me to hold items for them and sell them i would not mind it and i am a trust worthy guy i would just take a small percentage of the final sale price.

Admittedly I was sceptical at first with Ebank but in the time that ive done buisness with them I would say they are genuine, though I would recomend you do your own research before taking my word on it. -------------------------------- To borrow a phrase:
