ok, now this may have some faults in the reasoning... but try to bear with the general principle of it.
hypothetically, say your corp was holding a 0.0 system. and your patrolling, guarding, whatever, someone comes in, in a rather large ship, ignores your warnings to leave or whatever, and just starts to go about their business mining or whatnot. not kill stealing, or mining in the same belt as you are, or anything, just doing thier own thing.
you go after them, and they destroy your ship. (no smack talk or anything, merely ignoring your warnings and defending themself) you come back and try again, they destroy that ship as well (maybe you brought backup, but they were destroyed as well) and this time, for dramatics sake, lets say he warp jams your pod, and tells you that if you attack him again, he'll pod you as well.
and he does so.
further on, lets say that by time you come back later or whatever with a huge force thats garanteed to be able to take him out, hes one way or the other not there. logged, left the system, whatever.
what would you do?
not go that far, and leave him be once he defends himself once or twice against you?
have some sort of KOS listing against him?
as I said... I'm sure theres holes in the "story", but try to follow the idea of the whole thing. oh yeah... his corp being one way or the other uninvolved in any disputes going on.
I also wonder what sort of reputation someone who did that would get... I would speculate that they would be severely defamed... even though the pirates "keeping" systems in those areas make such a point that you only have as much ownership of an area as you can defend....
kinda rambling here a bit...

If you get pwnd twice by him, i would rather get me better skills or bigger back up.
So now he left and you want to know what to do right? I would say if its from that high rated topic, get the help of an agent figure out where he is get there close the door and turn his lights off.
If he logs he must came back and you could scan for his ships and own him. If youre not used to do it ask ppl to do that 4 you and pay them for it.
You also can declare war on them and get everyone of the corp destroy there ships and tell his m8s thats only infact of him. May be he becomes a freelancer cuz his corp cant whipe out the situation or let you pay your losses of the ships. If it was from another Alliances forget all of the above and move yourself to the war.

Your Corp was "holding" that system. (or you were alone in local, whatever ). Someone came and wftpwned you, so you dont hold it anymore at that time.
What do you want? Fair game.

oh, and btw: you dont need to be involved in any disputes to do what the guy did. Its a game, not the UNO.

I'm confused, you say your holding this section of space - do you hold title to it Your basically sqatting in this section of space and a superior force owned it, and you, for a period of time nuff said.

If I and my corp ever claim to "hold" a system and a single pilot is able to not only enter but operate in that system with a ship as big as it would take to kill us... twice... I would disband my corp and become an empire space ore thief. Then after a couple of weeks I'd cancel my account and go play SWG or something.

I made up the scenario.
the reason I ponder that it might be taken very badly, is the way some people seem to treat territorial disputes... and "defending" them...
part of the point of it being that the "invader" is not trying to take over that system, or attack you, or start a war, or anything. but merely trying to do their own little mining.
I would expect if such a situation were to occur, that the person would be heavily defamed, and very agressively attacked... much like as was said in the first response.
which honestly I find amusing. to take such a thing so personally, and so badly. if they were going and stripmining your back yard... I might understand that. but this is one person, doing thier own little personal mining. wouldn't it be more sporting to simply let it go?
S3VYN, given, part of the hypothetical would be the person being somewhat of a badass...
this being partially inspired by hearing of how so and such alliance has this and that region/section of space, or whatever.... and another alt, when exploring 0.0 was... kicked out of a system. a little newb in a rookie ship. now what the hell threat is that? spying?? on what?? seeing whos in what system? what stations? what about the people who just want to mind their own business? why should they know, or respect your "borders"?

I dont think there is any single ship that can mine alone in 0.0.
Hunt maybe...and even then you wont be in the best PvP setup.

Holding a system means everybody who leaves the local of that system should be only the spirit of them. Who activates the clone.
Holding a system means everybody who jumps in cant jump out. even if youre a gang of 2 mates and there are 3 gates...
Holding means just WTFPWND for the jumper...

If I were in that corp that "claimed" that system, I would have fit a Scorpion to scramble/jam him, better if with another wingman to add some support like another scramble/webber, and then talk to him, telling him that sys is claimed and so on, same old stupid stories ;)
If you simply go there to attack him, you risk to be shot down, that is why I would have put myself in ad advantage position before approaching him.
If happens what you described in your scenario... well, that corp never really "held" that system, they just claimed it and a stronger force showed them their fooliness :)
