I recently saw an auction on eBay for an Eve character.
At the bottom of the description was what I suppose to be a legal disclaimer:
"LEGAL ISSUES:
This auction is for TIME SPENT playing Eve-Online. This auction does not, in any way or form, include a Character, Account, items or assets within Eve-Online which rightfully and legally belong to CCP (owners of Eve-Online). I am SPECIFICALLY auctioning man-hours spent by me working in Eve-Online, which will be properly and legally receipted as such. A GIFT of a 45m SP Eve-Online Character will be freely, without prejudice or recompense, made to the winner of this auction."
Aside from the obvious spam possibilities, how does this Disclaimer hold up against the EULA?
Just curious...

It's a tortured workaround of the EULA language, or what the auctioneer is hoping is a workaround. The end result is still the receipt of an Eve character for real-world cash. I'd steer clear of this.

It doesn't
Doesn't matter how you word it, or what crap you claim you are pulling, it is still a violation of the EULA, and you can expect that character to be banned as soon as CCP has evidence of the violation.

And on that note, OP, you should file a petition or inform CCP of the character's name and provide them with a link to the auction. Now that you started this thread, CCP is aware that you know of someone conducting RMT.

Paying real-world money for anything ingame is a violation of the EULA - whatever you bought will be removed (so your cash is lost) and your account may be banned (costing you even more).
Some people think the disclaimer will get them around the ban on selling/buying ingame stuff - those people are wrong.

Petition entered, pertinent details revealed (to CCP) and thank you folks. For some reason, at the time (I can now reveal), I was a bit tempted...
But in my (fairly thick book by now), being honest always pays.

I am aware that you can buy Characters for iskies, yes. And much as I, like many others, would like to advance more quickly in the game (after all, I could be dead, or married, in two years), my net iskie worth at 6.5m SP is a paltry sum compared to the Getty-crushing figures being touted for 2-yr-old+ Characters.

If you pay them money and they give you in game items/characters/etc, how can it not include those items/characters/etc ?

Just like the 'free gifts' stores give out during promotions, except that these auctions are never present without the gift. Or if they are, no-one buys them

There isn't any logic there. Even if they do manage to convince me that they aren't selling in-game items, they are still profiting by helping someone buy the in-game items.

Yes, but you can buy game cards and sell them for isk.
