Go round to their house with a bat (baseball or cricket)
if they have your bike, commence beating, try not to cause any major damage
take bike back
Beat some more, break their fingers
If they go to the police, claim that they were unhelpful and therefore you had to to take matters into your own hands, due to the lack of free beds in prisons etc, you will most likely get off with a suspended sentance, if it even goes to court.

Your situation is - one everyone shares, not just in the UK. Do check the pawn shops and used bike stores. Hopefully you have your name or serial number on it, or proof that it was yours, and the shops have a record of who sold it to them. An employee of mine stole things, and sold them at a pawn shop, and was later busted - because she signed her name to the transaction. |

IMO, the police are never helpful. They are more interested these days in soft targets like motorists and such. They cut the crime tremendously in Aberdeen by going on a rampage and nicking all those who took a whizz in a public place because the council do not provide adequate public toilet facilities. The law has become a farce in the UK with major crimes going unpunished while petty offences get maximum penalties. They may as well legalise theft because the government themselves will steal your car if you don't tax it and steal your posessions using bailiffs if you don't pay the council tax.
Since part of that council tax goes to pay the police, I really believe the people of the UK should take a stand and refuse to pay that percentage until the police start doing some real work against the crime rate.
In the meantime, I can only agree that taking the law into your own hands may be illegal but if it's the only way we are likely to see justice in this country, that's what has to happen. Your defence in court would be a statement that the police are nothing more than glorified traffic cops now and do nothing to prevent real crime so it appears that the burden of enforcing the laws has fallen to the people. A vigilante maybe but if enough of these vigilantes stated exactly those words in court as their defence, the message would eventually get across.
The biggest problem in the UK is getting enough like minded people with the guts to go through with it and not back down when it gets rough in the courtroom. Am I prepared to go to court for making a stand against crime? Hell yes! Am I prepared to make the police look like kindergarden graduates that couldn't catch anything that doesn't have four wheels and no tax disk? Hell yes!
Drugs are a major cause of crime now and it's about time someone stamped on the addicts HARD! Stop this stupid soft touch approach of weening them off with Methadone etc, cold turkey makes them think twice about going back to drugs cos nobody in their right mind would want to go through that again.
I don't blame you for venting agression about this, I've been venting the same anger for a long time to no end because everyone in this country is too much of a weener to make a stand and say something about it. That's why this government and all the others before it have always walked all over us, taxing us out of existance, giving the police extra powers to prevent petty offences but taking away their powers to enforce the real law and so on...
Not taxing your car is a hanging offence but molest a kid or commit **** and you'll just get a slap on the wrists if they can actually be bothered to arrest you to begin with.
I am a security guard and of all the shoplifters I have caught, less than half even got a spot fine. Most were professional shoplifters who were known and have been caught several times. The amount they steal in one day pays the fine and brings them a comfortable income that makes my wages look like pocket change. How does anyone think a 10 quid spot fine is going to prevent this sort of crime?
I called 999 to report guy with a pickaxe handle smashing the entrance gate at the harbour. Only two security were between him and his ability to gain access, I was worried that he would attack us to gain entry. Security do not get issued body armour or any form of defensive devices like CS gas etc so we were completely defenceless. A full description was given, the camera was swung around to capture it as I was calling the police. The outcome: The guy eventually calmed down and walked away and we never saw the police at all. 2 weeks now and they haven't even come round to get the CCTV tapes.
The police have body armour and a whole arsenal of defensive stuff but the wussies didn't even turn up, they left two unarmed, unprotected security guards to deal with it |

Beat the guy up with some friends, all wearing masks. Take back bike, then put bike back where you had it before, chained up etc. Maybe with a camera pointed at it this time.
They'll be in the position you're in now ... they 'know' who did it to them, but can't exactly go to the police "I know he did it because I stole his bike and now it's parked back where it was before".
Might want some additional security vs retaliation at this point. But as long as you have cameras set up at this point, you'll have more of a foot to stand on.
Alternatively, if you know for sure they're junkies, report that to the police, or something. -omg-

If you can see your property inside thier house from the outside, without breaking in.(a tall ladder comes in handy at this point- so you can check out the upstairs rooms) (now, here's the bit where you get your biggest and nastiest mates round for a drink or 2(at the same time))
you have the right to gain entry to recover your property (this is the law) you can of course ring the police and let them know that your stolen property is inside that house and you 'WIll' be forcing entry to recover your possesions.
(they will no doubt try to dissuad you saying it is illegal to break in, but you have the right under BRITISH LAW. They will then have to send a car round cos all hell will undoubtedly break loose shortly, and they have to keep the peace, even if they are taking the **** in the first place).
They can arrest you for breach of the peace, but cannot arrest you for breaking and entering!. If your property is found on the premesis, they will be forced to arrest the occupants of the property you have recovered your bike from, though you will have to demand a complaint to be made against them for procedings to be made CPS are a bunch of morons. you will probably lose the bike for a several weeks if the police take this action as CSI will need to dust the bike for prints (maybe), anyway it is evidence, so is required by them for the court case.
GOOD LUCK, and dont forget the POSE' before going round next door. i might also suggest a infra red camera and night light, and also a new taller fence between properties.
failing that, if they have a car or 2 parked outside, you could always spl-ash the tyres and pour paint strip-per on it and daubing pedro-pille on the cars always goes down well... [this is not a suggestion, but something i heard in some pub down the road many years ago that someone somewhere did, but is probably a viscious rumour that didnt really happen- much like knowing the bloke who won the lottery]

Edited by: P''uck on 23/10/2008 17:15:51 Good luck on getting it back... I have no clue how the frack this works in britain, but I guess if you really know how took your bike there MUST be a way of getting it back, assuming it hasn't been sold already...
On the other hand... how can you be so sure of who took it?
Anyways... next time: if you stay somewhere overnight, and your bike is more than just a rusty turd, take it the **** inside. Never ever leave a bike chained somewhere for more than a few hours, especially if those hours are without daylight.
It sucks, I know, but I rather leave my bike inside the flat than going through all the hassle to talk to unmotivated and potentially mentally challenged coppers... (in 20 years I'm down by 5 or 6 bikes, I can't really remember, and NEVER EVER has the police be able to help even the tiniest bit.)

Fun fact:
If you've reported it stolen to the police, and then find it in a pawn shop, the pawn shop LEGALLY has to give it back to you, no charge. The law says that stolen goods belong to the original legal owner regardless of how many times it's resold- as long you can prove it's yours (should have a serial number on it), they have to give it back. |

Interesting fact:
Buying something from an open-air carboot sale before three in the afternoon legally transfers ownership of the item to the purchaser, even if the seller was not the previous owner.
Though I think this may just be one of those laws that don't apply anymore, like hay in taxis and peeing in policemen's helmets. |

I got some questions for you Pete.
How do you know that your new neighbours are drug addicts and thieves?
Do they have copies of court documents relating to their multiple convictions pasted up in the front windows?
Do they regularly invite friends round to shoot smack in the front garden? Have they put up a big sign at the front of the house that says "WTS: Illegal Substances, Cheapest in Region"?
You put two and two together and came up with possibly four... but it might also be three or five. How is it the premier EVE forum warriors phrase it? .... proof or STFU!
And just look at the excellent advice from the legal experts in the forums tonight.
"Go round with a bat" suggests one.
"Beat the guy up with some friends", suggests another.
"No one cares if a couple of drug addicts get smacked around a bit, least of all the police. Confront them with some aggressive friends and show them the error of their ways." says someone else... obviously an experienced barrister this guy.
One particularly moderate and enlightened soul suggests going as far as torching the entire house... presumably with the express intention of killing all inside.
Does any of this strike you as a little bit of an over-reaction?
Last time I checked, the penalties for theft were at about the level of small fines and short custodial sentances for extreme cases. Nowhere have I seen a sentance of a good kicking from the lads passed on an offender. I also don't recall a horrible flaming death being handed down for being a relative housed with a suspected drug addict suspected of petty theft.
How about you follow some of the more moderate advice offered and do the rouds of the local dens of iniquity where whoever it was who stole your bike might have offloaded it? If you find it, contact the rozzers again and I'm sure they'll be happy to help you out.... maybe.
Incidentally, if the theft of your push-bike has "ruined" your life, might I suggest that your next port of call should be a psychiatrist rather than the solicitor you should have gone to with this badly thought out whining? Sounds like you're not too tightly wrapped.

yeah, dude...
it don't matter how many people it goes through, if you find your gear and have solid proof it is yours, the last person holding it will be done for possesion, along with everyone fingered for handling and passing on stolen goods, all the way up to the low life that stole it in the first place.
btw. a lot of white stiff packaging(the kind you get your PC case packed in), a sealed leak proof bucket/container, and a something you buy to run a car on, will get you in lots of trouble with various official people that like to (eventually)send ppl to gitmo... so be carefull...
or you could just use a towel and some wire cutters to quietly clip all the spokes of thier bike wheels
Oh and dude don't get me started on all the fun you can have with Crayons, seriously, you really don't wanna go there...

Completely untrue.
According to the Theft Act 1968;
"A person handles stolen goods if (otherwise than in the course of the stealing) knowing or believing them to be stolen goods he dishonestly receives the goods, or dishonestly undertakes or assists in their retention, removal, disposal or realisation by or for the benefit of another person, or if he arranges to do so."
This means that the CPS would have to prove intent (i.e. that they expressley knew, or suspected, that the goods were stolen) on the part of parties handling the goods after the theft.
In a civil case the standard of proof is on the balance of probabilities, but in criminal cases, such as theft, the standard of proof required is "beyond reasonable doubt"; very difficult in such cases to prove.
If the bike showed up at a local pawn shop/smack converters/fence and was handed over when title had been proved, then no offence of theft or handling stolen goods has been committed, or more accurately has a chance of being proved to have been committed, by whoever had it at whatever point along the chain, with the exception of whoever took it in the first place.
If this wasn't the case, then smack converters and pawn shops would shut down overnight as every single one of the emloyees of such places would be doing up to 14 years in chokey for handling.
I'm not sure where you're from TU144, but that's how it works in the UK. Perhaps it would be better if you stick to commenting on things you actually have some smattering on knowledge of? Just a thought.

in some countries reading that suicide joke-book will get you GANKED! in RL.
I havnt seen That! joke e-book in a long time (12years+). and i have never seen the real deal. and what i may or may not have read was more a FBI/CIA sting than anything else, cos a lot of the details of it's DIY were Soo very wrong they would definatly get you killed if you tried them. [anyone remember seeing in the news over the last 10 years, some kids blew thier bathrooms up(probably blew thier hands off as well), LOL, muppets)
only an id10t would try getting it these days...
Anyway anyone who has served in any military service will already know such info and i think both here and on WOW you already have alot of RL serving weapons specialists currently on active duty.
How about the real big boys WMD toys...
Is it now illegal??? to read details on what a good old(1940's) manhattan project toy looks like , considering such sketches were very much in the public domain in a lot of books when i was in school, and as far as i am aware they still are? I mean there are lots of movies about that project and nearly all the design could be easily worked out from simply watching the movie...
Do they still teach Cheimistry these days? it used to be A'Level chemistry (if you had a x-MOD teacher) he would impart a few juicy bits of info, and lots of stern lectures on why you realy shouldnt mess about in class. usually by showing how some things you cannot buy go BANG when mixed the right way
anyway, were off topic. Dude, check those nasty neighbours out to see if ur loot is there, if so gank them!

Unless you actually saw them take the cycle - there is not a lot you or the police can do,
i saw someone post if u can see your property in their house you can enter and recover - no u cant, you will be commiting criminal damage entering the home
other advice here which mentions committing crime - vhrist its a bike get over it injuring, killing, damaging property ALL of which a major offences just for a case of theft - not worth it
The Police will note what you say and log it but until you have evidence or they do there is absolutely nothing u can do.
Might i suggest a better means of securing your bike - you have to take some responsibility for the theft |

A person is guilty of theft if he dishonestly appropiates property belonging to another with the sole intention of permanently depriving the other of it (or summat like that)
The poster is correct re handling - end of story is the police/cps have to show evidence that the handler KNEW it was stolen so more than 'he has it' as evidence is needed.
Just get a new bike - keep an eye on the local car boot sales and streets - did u mark it with a security mark btw?

My own experience from Aberdeen Harbour of police not even bothering to come out for a 999 call I made.
The fact that Security guards are front line operatives dealing with sometimes vicious thugs who think nothing of using knives, needles and such on security guards. We are not even issued protective "stab proof" vests and yet we now have to do the job that only the police used to do once - Arrest and detention until the police arrive. The fact that I have been assaulted on numerous occasions whilst arresting shoplifters and such.
I have seen teenagers shouting abuse at police, knowing they are powerless to do anything about it.
The fact that my own car was broken into and the police actually caught them red handed due to a patrol coming around the corner while they were in the act. No prosecution came from it even though they caught them in the act and had a statement from a neighbour who watched them do it AND could identify all of the perpetrators by name.
My reply was to the OPs post elaborating how the police have lost thir way as far as law enforcement is concerned. Not only as far as following up on theft but many other things as well. I also made it clear, just the same as almost everyone else who replied, that people are being forced to take the law into their own hands simply because the police won't act on it. Whenever you call them now, you often get the standard response that "there are not enough patrols available". However, they managed to find two patrol cars at the samme time to pull me over because my road tax was three days out of date.
Ill informed? I think not!

i saw someone post if u can see your property in their house you can enter and recover - no u cant, you will be commiting criminal damage entering the home
Yup!
i had a former friend, who thought he left something in my house after i chucked him out for being a douchebag after stayin at mine. He came back with some mates and attempted to break into the property when i was out.
I came back and found him trying to break in, i called the police, who ran round!(this was back when they were interested in SLA's and catchin crooks)
They then advised him that he DID! have the right to force entry to recover his property, but causing significant damage to doors or windows (all double glazed) was probably not such a good idea.
they let the B45t3rd go off scott free....
