sorry to sound so carebear, but say I am mining got a little cargo container out, is there nothing I can do if someone comes along and steals it?
If I shoot them the Con people come around and blast me, if I don't I am just mining for others.
seems like a bad issue all around.

If it's an insecure container, then yes anyone can take from it. You can gain anchoring skills and use secure containers (password protected). I don't think those hold even early as much as the jettison ones, and they do cost a lot.. but it will keep your ore safe. Other than that you could search around for a .9 system where you are all alone and setup there, or run back every time you fill up your cargo to sell.

Secure cans can only be ancored in 0.7 and below.

I see password protected cans all the time in .8 .9 and 1.0 system.

Well apparently they are anchored, since they were created before the patch that only allowed anchoring below .8, but that isn't an option anymore.

as far as i know, if you make a can and somebody takes somthing out of it, you are allowed to open fire and kill them for the next 15 minutes without concord doing anything. Don't take my word on this though, this is just what i heard. Can somone else very please? _______________________________________________________

This is 100% false and either started by a hopeful carebear or a very naughty person. If the latter, then I like it . CCP's official stand on ore "theft". Live it, like it, love it.

And btw a jettison can is concidered thrash so free to take according to regulations.

If my really bad memory serves: in a recent blog the "devs" mentioned that this situation would be addressed soon(tm) and that Jet Can theft will count as an act of aggression. If I remember correctly, only yourself, gang members and the originators corp will have access.

Players mine and drop into unsecure cans, feeding the ore thieves and then the players sit in local and start becoming immature and rude. If I was starting off now, I'd sure as hell steal from cans all the time. It would be a good laugh and a good way to get on my feet in EVE.
If you have issues with ore thieves, use a secure canister. And if you can't do that, get an indie to sit on the can and keep as little in the can as possible. If that isn't possible, haul every load to the station yourself.
Honestly there's no problems with ore thieves. It's the same as there's no problems with PC Pirates killing new players that aren't even a week old in 0.4 Systems. It's apart of the game, and PC "Victims" have to accept the fact 90% of the time they're the reason these greifing players stick around. (PC=Player Character for those that don't know.)
Feed the strays, and they will return everynight for more.
