As a trader, every so often I pick up an un-researched BPO for less than NPC price. Most of these BPOs may be sold on the market, but occasionally I am contracted one that cannot be sold on the market, despite being ME/PE 0 and otherwise indistinct from an NPC-bought BPO in every way.
My assumption is that these are BPOs that had research started on them and then canceled, but I am really only guessing here.
Can anyone tell me what makes these BPOs un-salable on the market and if there is any way to distinguish them from other, "normal" BPOs?

If a blueprint has ever been used for anything ever, building/research/etc, then it is "unpackaged" and cant be sold on the market

Well, that answers that. Thanks :) Is there any way I can check (other than asking the seller) if a BPO has been unpackaged before I accept a contract?

then why when i bought 1 too many orca bpo's, did it say it can't be sold on the market?
i owned it for like 1 minute and it refused to be sold, had to do it on contract.

Yes it is true that once a BPO has been unpackaged it cannot be sold on the market. You can tell these in the contract if they have ME:0 and PE:0, basically the stats written down. The stock unreasearched BPOs(the ones that can be sold on the market) wont show the stats at all.
