I loled hard.
One has to wonder, though - if they were going to pull this kind of shenanigans, why NCSoft as the first target? ----------------

They're grinding weaker mobs to gain levels so they can take on the bossmonster, "blizzard".
On a more serious note... why exactly didnt blizzard sue codemasters for LOTRO? I mean even without a patent it seems they stole the whole deal.
Or does blizzard actually own codemasters?

Because if they fail they don't want to be too much in the spotlight as if they'd hit Blizzard, but still a large developer, or something, I suppose. ------------------

They probably thought NCsoft would crumble. Once one company acknowledges their patent and pays up, that sets a legal precident that makes it much easier to enforce the patent.
One of the big problems with this is that they have apparantly had this patent in the works since 1996 but have never once tried to enforce it. It can't possibly have escaped their notice that "their" technology was being used in a multi-billion-dollar worldwide industry. A company that blatantly doesn't enforce its patents will lose their claim.

Massively.com has an interesting follow-up article that explains that, despite what appears to be significant prior art, the defence isn't clear cut, has a word about the timing of the lawsuit, and why NCSoft was chosen as the first target.

Wow this is simply asinine. They would in effect be sueing every MMO company that has existed, because of the presidence this would set. That means, Verant, SOE, EA, Blizzard, CCP, Warner Bro's, the list goes on and on.
There are certainly some big names there, and as such it wouldnt shock me if they aid in NCsoft's defense as if the suit is awarded, it has huge rammifications for their own profits.

I am asking some people who know about these things (read lawyer types) their opinion and will let you all know when I get a response.
On the face of it I cannot imagine this patent standing. It is too broad. It'd be like patenting the layout of the QWERTY keyboard. You cannot do that. You can patent the design of your particular keyboard but not the layout of the keys.
I agree with the poster above that it would behoove EA/CCP/Blizzard and so on to contribute to a legal defense fund for NCSoft. If Worlds.com succeeds they are next on the hit list anyway and it'll be a lot harder to defend.
Basically Worlds.com sounds like a failure of a company so just wants to bilk everyone else of their money with a BS legal maneuver. I hope the court smacks them with a frivolous lawsuit charge but I seriously doubt they will.

Thats just bloody stupid its like trying to sue FPS developers because all FPS have a similar HUD layout with ammo and health etc and the same for RTS games, its freaking absurd why isn't there laws to punish people or companies that file bull**** lawsuits?

There already are rules about this (Rule 11 of the Federal Rules of Civil Procedure for one thing). Unfortunately (or probably fortunately actually) the legal definition of what constitutes a frivolous lawsuit is different than what most laymen would deem frivolous. The arguments over what should constitute a frivolous lawsuit have been ongoing for ages.

Just remembered this game and it predates all other MMOs. Meridian 59, the FIRST 3D MMO out on the market, even beat Ultima Online and Everquest, came out well before Worlds.com even filed their patent. -------------------------------- CCP can patch away bugs, but they can't patch away stupidity. |

this is likely HIGHLY contentious.
IS there a point where something that would normally be considered terrorism (or at least violent activisim) suddenly becomes valuable public service?
Cos theres a set of legal offices right there, the exploding of which would increase the average IQ of the planet by a significant amount...........
adding the people that actually filed for that patent just on general principles would help too i think. ...in accordance with the prophecy |

I wonder what would happen to the world and the world economy if 2 things were to be done:
Abolish all patents, and drop the entire system. Make the entire world move to only 1 valuta (euro, dollar or whatever, it doesn't matter).
Those 2 things will make a lot of good things happen ^^

ig nobel prize
Technology - Presented jointly to John Keogh of Hawthorn, Victoria, Australia, for patenting the wheel in the year 2001, and to the Australian Patent Office (IP Australia) for granting him Innovation Patent #2001100012 (In Australia, innovation patents are not examined - and not enforceable until they are examined - and are only subject to a formality check, so there is essentially nothing surprising in the Australian Patent Office granting of such innovation patent [7]). uʍop ǝpısdn ǝɹnʇɐuƃıs ʎɯ ƃuıpɐǝɹ ǝɹɐ noʎ

Not only are they a soft target, but if they win against NCsoft, any future claims they make have a precedent, meaning that any defence CCP or Blizzard throw up will easily be cast aside.
Personally, if I was running a large MMO company, I'd send a legion of lawyers to help NCSoft defend themselves. -----
