Terms of surrender are up to the CEO's of the corps at WAR, ISK, teritory mining rights, whatever. CONCORD doesn't enforce any part of a surrender. Freeling killing another corps members without CONCORD involvment is it's own reward.

Yes you can. Corp members are fair game anywhere, CONCORD will not get involved. This only applies to corp members btw, gang members from another corp are another matter and will get a CONCORD response.
