Well.
Consider this.
"the cashier told her all sales are final"
Customer tells the cashier thier order. Cashier rings it up, and says what the price is. Customer pays. Cashier then says "We don't have the things you ordered" Customer asks for money back. Cashier says "All sales are final"
But no sale has taken place, has it?
Isn't that theft?
Offering a cheaper item in place of the item you don't have, is also a sorry state of affairs. It's normally a more expensive item you offer when there's a shortage.
Still a bit to get the police involved, unless the manager was also being a jerk.

The problem isn't that she involved the police - it's that she involved 911 which is supposed to be reserved for true emergencies. Her life and well-being were not in any danger - she could have just as easily filed a report at the police station. Hell, complaining to a manager would have been a better idea - they are bound by corporate policy (and by law, I believe) to offer a full refund if the product and/or service purchased can not be delivered. And if the manager was in on it too, complaining to McDonald's headquarters would almost certainly work. Not only would she get a refund, but she would probably get a free meal card AND get the manager responsible fired (and if not fired, at the very least put on very thin ice).

Just had a thought though.
Given the irrationality displayed by this woman, it does kind of look like the establishment might have had to call 911, in order to report a "dangerously angry woman" or something.

I would be angry too if I ordered something, gave them my money and for them to tell me I can't have it OR my money back.
I wouldn't dial 911 (or in our case 999) though.

Erm, could someone explain me what "final order" means? I'm not a native speaker and dictionaries and google aren't were helpful (found a hilarious page from some kind of sect though). Please keep that mind while reading the following post.
Asides from that it seems not in agreement with any German law to take money for something you can not provide (without stating that you can't do so and offering an alternative product during the sale, which gets agreed on) and a refund is in order. Is that different in the US? Or is "final order" a term that means "You'll not have a choice what you get and we just give you something regardless of what you ordered."?
Calling 911 (or 110 for me) is a bit over the top. Gathering witnesses and calling the local police station to file a complaint is a different story though. In case I get scammed and finding a "peaceful" solution is not possible I'd totally try to fight for my right as a customer. Can't say for sure if this applies to the McNuggets-news because the story lacks information regarding the sale itself, in my opinion.
That's at least the most "sane" reaction I can come up with but not a realistic personal scenario since I believe there's no possible incident reagarding the sale of McNuggets, which can't get solved by talking to people (or hitting them with those trays they keep on the counter).
Unless I'm drunk (but that has just become an issue since I moved to Ireland).

I actually agree with he customer on this one, they should not have told her she can not have her money back thats just plain stupid. No sale was made as no products, goods or services exchanged hands.
Should she have called 911? no.

Not really a term that should be used in the food industry. A better definition may be if you buy a used car and the sticker has a 'as is' printed on it. This means that once you have brought a car any issue you have with it is your problem, not the dealerships.

Yeah they screwed up on many accounts. When she was at the counter or the drive up box they should have mentioned to her that they were out of Chicken nuggets when she ordered them then, not after she gave them money. That's just poor management and failure to communicate there.
And they have no right to tell her that she cannot be refunded, that was simply wrong. They could have given her money back and she could have driven to the next McD's that is probably 2 blocks down the road and gotten nuggets from them.
I'm quite sure that corporate is looking into that store now.

Accidentally selling someone something you've run out off = non-issue. Cashier plugs order into till, computer relays it to the back. Cashier has no feedback on current stock of product X unless someone takes initiative to tell him/her.
Refusing to give refund on product you are unable to deliver = blatant petty theft. Honestly, I probably would have also called 911 and refused to leave the store until either I got my money back or some one got arrested. Or smash the cashier face into the till and run. In before Ralara. |
