For some reason when I restarted EVE I got a patch update.. ok no biggie, I let the patcher run, restarted the client when it was finished and I got.....
Incompatible (protocol)
the version listed is: 6.12.88737
Any clues here?

This. It was the exact same thing when the Apocrypha major patch came. Makes perfect sense for CCP to deliver the patch in patches (har har har), less traffic/load and speed up the process when server goes up.
There's a couple of other benefits as well, but the point is? Get used to it, this is here to stay. And personally I think it's a good addition by CCP. The new patching process is great.

two days ago i d/c'd in randomly and when i tried to reconnect it gave me a patch notice, 3.8 megs same as i've just got 5 minutes ago. I thought it was odd, said no, and it just let me connect.
So now i'm wondering if i should download this new patch.

and im not re-DLing eve. i did that twice last patch becouse my PC crashed during patching the first try.

Hehe. That's an issue with CCP tho, not this system. It's like saying 4-4-2 doesn't work in football because team XYZ fails at it. Clearly seems to be working for ManUtd.

doing a new download would erase any market folders and other such goodies correct?

Just downloaded the full client after reinstalling Windows. Jumped up told me their was a patch, installed.... "Incompatible (protocol)".
So no, downloading the full thing isn't going to side step this one.
