I'm glad of this ruling as well - the manner in which the search was conducted was a clear violation of the 4th Amendment, which is binding on ALL government employees, not just law enforcement. It sets a very poor and dangerous precedent when we tell our children they have no right to due process, simplified though it may need to be. |

it's a bit more than violation of privacy, though that's certainly part of it, it feels like an understatement...perhaps child molestation would be an overstatement, but it's certainly between the two...

Hm. Not sure what the best intentions could be, when the intention is to strip search a child to ensure they don't have any painkillers on their person (yes, great, lets protect the kids from over the counter perscriptions they could take at home. if they weren't protected from painkillers, then they might have to deal with not having headaches or period pains, and crikey, then they might be able to concentrate on their school work...) on the basis of an unsubstantiated tip from another child...
I'll agree with them being horribly incompetent, but it seems more like they were just trying to forcibly get her to comply with their own policies in the most controlling and humiliating way possible without any real evidence that she was breaking them...rather than actually giving a damn about her personally.
Not sure it matters really who did it or how official their capacity was. Yes, if she had a medical condition which required someone to look at her breasts and pelvic area for her own safety, then a doctor or nurse would be required, but even then there should be the issue of consent. Given the reason for the strip search was checking up on possible deviation from the school rules, it doesn't make much difference if it was a cop, teacher, principle, nurse or doctor - none of them have the right to do so.

Surely you'd want to cover your bases and make sure you had an officer there and even better inform the parents straight away to come and try and deal with it before the search was necessary?
Mind boggles at the sheer idiocy
