Hello,
I am writing this thread as a last ditch attempt to get someone's attention in the vain hope that I can bring my many petitions to some sort of closure. I have two eve accounts, my main account and a second account with some cyno alts, I have played Eve for about 2 years with these accounts with not so much as a single problem (excluding stability problems after the last expansion, but who didint) I have made my isk as a part time character trader, I have bought and sold on the forums about 7 times. About 10 months ago I was bidding for a very nice toon called Nyx Steelgamers, I was the winning bid but when it came to exchanging isk and toon the owner told me that 'he was having problems with his bank card as it had been cancelled' He told me that he was leaving Eve because of personal problems and that he was prepared to give me the entire account, he further stated that he had about 2 months of prepaid game time left and that it would be a shame to waste it. I thought that this was a pretty good deal that suited all parties, I got some extra game time and he saved Ç20 so I went along with the deal completely unaware of the EULA rules on account transfer.
The prepaid game time ran out and I continued to pay for the account via direct debit, about 4 months later I sold Nyx Steelgamers and bought another character, this occured a further 4 times until I ended up with my main character atm Velociter who I have had for about 4 months.
About 1959 on Fri 1 Aug I had my main account hacked and all my isk 422 Mil stolen, all the ships in my hanger 1 Megathron, 1 Phobos, 1 Helio and 1 Eris where stripped and sold on the market to buy orders, my Moros was stripped and all mods now in my hanger appeared to be reprocessed and the minerals sold to buy orders on the market all in all I lost about 1.3 bil isk in isk and mods/ships/rigs.
about 2008 hrs the same day I log a petition explaining what has happened I then carry out a number of scans on my PC looking for keylogging programs as I have never shared my login details with anyone.
About 2200 hrs I get kicked from the server, I try and log on again but receive a message that my account has been banned pending an investigation, I ask around as I am unaware if this is standard procedure and are informed that it hs been done to protect my account from further hacking. I change the PW's to both accounts.
I e-mail Eve Online support explaining what had happened then I wait for about 4 days for them to get back to me but nothing happens. I then log another petition with an alt from my second account Punchy McFist explaining again what had happened and that I would really like it if I could have my account that I have just paid for back.
On 8/6/2009 GM Twinni replies to my message and states that in order for them to give me my account back I need to provide them with some details proving I am the owner, I answer all the questions and send my reply.
GM Twinni gets back to me stating that I dont appear to be the original owner of the account and can I explain how I have access to it.
I send back a message explaining how I can to have to account
GM Twinni replies we will be unable to return the account to you as you are not the original owner of the account. Account transfers are forbidden by our EULA.
Totally gutted I reply that I was not aware of this rule and that it was abannable offence if I did then I certainly would not have brought the original petition, I go on to request that even though the account was transferred the original character is no longer on it so would it be possible to transfer the toon or could I pay for another account and transfer all to that, there must be some way to sort this problem out without me losing my main character.
I have yet to receive a reply

On Fri 6 Aug I sold Punchy McFist for 1.5 Bil on the forums in an effort recoupe some of my losses I log on, on Sat to find out that that account had been hacked to and my 1.5 bil isk had been stolen.
I petitioned this straight away however I still have access to this account and a GM is yet to reply.
I realise I did a silly thing 10 months ago but does this warrant a ban, does anyone else feel that the petition system is utter rubbish and needs to be replaced by something abit more responsive we do PAY to play this game after all and shouldn't we expect a little support.
I think its abit sick that I am the one who got robbed and brought it to the attention of the GM's only to be punished for a minor infraction, if its a matter of the transfer fee that CCP didnt get then I am totaly willing to pay it.

There are rules, you broke them, even though you claim you were not aware of the rules they are stated in the EULA and most players are aware that sharing/trading accounts is against the rules. You should have read the rules before any transfer was done as to ensure the safety of the transaction.
CCP will not give you any isk back and they will not give you the traded account back, any other account that is linked to you (like the one you are posting with now) is at risk of being banned too. If you are banned on one account then you are banned from the game completely, they only way to get round that is to have an account that CCP don't know it's yours but as you have posted on here expect the ban stick to fall soon.
And no, I do not have any sympathy for you, the rules apply to everyone so all is fair.

Yes and no, depending on your perspective, but either way, the outcome is the same.

Like what? A rush-job system that will make people lose their stuff left right and centre? It is responsive for the simple matters; it is not responsive (by which I suppose you mean "fast") for the important matters, nor should it be considering how complicated these things are and how important it is that they get things right.
In addition, you've been caught up in the middle of a massive workload for the GMs, since (apparently) tons of people have exposed their accounts and had them hacked.

You played for 2 months using an account someone else started and paid for. So the fact that I have had all my assets stolen isn't punishment enough, I haven't actually hurt anyone, in all walks of life there is flexibility, even a criminal gets a leaner sentence for the first offence. Its nice to see that those who have replied so promptly have put alot of thought into their replies, not pompous automatons at all, :)
I hope none of you fall foul of the rules

Seriously, what else do you expect ? Realistically, how exactly did you hope this would resolve, once you DID find out about the rules ? And after you answer that, answer this too : how can CCP know you really did "receive" the account from somebody else, as opposed to, you know, just "stolen" it (or worse, bought it with RL cash) ?

Zero worth, sadly. Only server-side logs matter. Everything else can be easily faked.

I suppose I faked the forum character sale too just in case this happened, FFS if I was aware of the rules wouldn't I just have transferred the character to an account I started.

Sorry, absolutly no sympathy, and you cant claim ignorance as you state you've made isk by buying/selling chars on the forums, and if i remember correctly one of the stickies clearly states that whole accounts are NOT transferable and has done since toons became tradable.
In short you deserve everything you get.
I would say 'can i have your stuff' but by the sound of it you dont have anything anymore.

I seriously doubt that... but you never know. And even if they HAD server-side in-game full chat logs... how can they know your conversation was with a RL friend who just left you his account (dodging the 20$ fee for character transfer in the process) and not some guy you just met with whome you have a combined ingame/messenger convo telling him what to say ? And we could go on and on about the paranoia mode, but it's of no relevance.
In EVE, you're innocent until proven "suspicious enough", and once "suspicious enough" you're automaticaly guilty unless you can prove//explain your innocence. Rules are rules, whether you know they exist or not. In this particular case, you're obviously not pleading "not guilty", just, you know.... mitigating circumstances, at best ? Basically, you are at the mercy of the GMs in question... and considering the type and volume of petitions they receive, I seriously wouldn't expect any leniency from them.
Sorry mate, it happened, there's nothing you can do about it now... ...except getting the original owner of the account involved, if you have any way of contacting him, so HE can recover HIS account, then pay for a transfer of the character(s) to your new account which you will create (if you haven't already created a new one.

Common sense says they have no way of knowing if you really received the account as a gift, so they shouldn't just hand it over to you. So... what... if I go around stealing people's user/passwords, all I have to do is change the pass, wait a few months, then take a small ISK fine or temp ban to keep all of it ?

They're pretty lenient as it is. You still have your accounts — they just won't return the account that doesn't belong do you. That account may very well be banned, but since you're not the owner, it doesn't concern you. They certainly can't hand it back to you since you can't prove it's yours — in fact, you've confessed that it isn't yours.
This is exactly why account transfers aren't legal: there is no way to prove that the exchange was fair and above-board, and it only opens up for scammers to steal accounts by falsifying evidence that the account actually belongs to them. ——— “If you're not willing to fight for what you have in ≡v≡… you don't deserve it, and you will lose it.” — Karath Piki |

It wasnt a mate, I bought the character from the forums it was when we were chatting to finalize the sale was when he suggested the account transfer, he said he was quitting eve but if the original owner reads this thread for the love of god please get in touch. Obviously a slim chance, I wrote this thread as a last ditch attempt to get a GM to take a look at my situation, it now seems that I have wasted my time
