Now anyone you tick off badly enough can get your real identity by filing a libel/slander suit in the US. I see a whole new breed of 'ambulance chasers' coming soon. This from a libel suit that forced google to up the identity...
Judge Joan Madden agreed with Cohen and ordered Google to give up the name. As the Times reports: The New York Supreme Court Justice ôrejected the bloggerÆs claim that the blogs Æserve as a modern-day forum for conveying personal opinions, including invective and rantingÆ, and should not be treated as factual assertions.ö
This was further expanded in the opinion to include any web origin and left the door open to much more. Should be interesting as many have already been reported to be taking action based on this new 'precedent' already.

Ambulance chasers are lawyers. They're not related to the medical profession themselves. They just follow ambulances around so they can get the people inside them to sue other people so the lawyer makes a profit. If someone in EVE-online said something slanderous the lawyer would then get the "victim" of said slander to sue over it.
- How to kill interceptors: Zip down your fly and release. After about 10 orbits your stream just might hit him. Or a multi webbed Rapier should slow him down enough that you can drop #2 on him. |

Just because you're online doesn't give you the right to slander someone. Honestly, I'm all for people being held accountable for their actions. The Internet is not some free ticket to do and say anything you want without their being repercussions.

Couple of points that makes it irrelevant to EVE.
- Miss Cohen was named and pictured in the blog. Most of us are anonymous alter ego's.
- There are virtually no RL consequences to a digital alter ego being defamed, therefore you have no case for damages. At best you could claim some emotional damages.
- Miss Cohen is a model. Models depend partly on their reputation to get work. They, and others depending on theirs, should be able to deal with things that are, falsely, damaging it.
- As mentioned, the company, the server and most of us aren't in the US. Extradition treaties apply to criminal cases. These kind of libel/slander suits are civil. You can be served, summoned and picked up once you enter the country, but you can't extradited.
All this taken together means we're still a long way from filling out a simple form, get name and address and drop by with a bat.

That's the biggest problem I see with it. Ridiculously easy to wave aside the accusation with "What time was that made at? Oh, sorry, I wasn't at my computer at the time, perhaps someone else used my account/username/stuff".

I believe in unconditional free speech. I feel that if someone calls you a ***got or a ****ing worthless subhuman individual it is up to you whether or not you take them seriously and believe what they say.
Disrespect coming from someone who is at a level above me is the only painful disrespect out there. When someone underneath you disrespects you, you would be wise to ignore them because they are beneath you. To give them the attention they want is to lower yourself to their level which is unacceptable.
So what I'm basically saying is who gives a **** if some guy in public or on the internet said some **** that you find offensive. Man up, get over it. Chances are the individual is either inferior to you or you did something and deserve it. Either way asking the lawyers to intervene with some damn lawsuit is a really childish way to handle your problems with someone.
The entire world needs to grow up. |

Exactly, try to argue with an Idiot and they were mearly drag you to their level and beat you with experience.
I cant ever see someone being prosecuted for flaming in an MMO, forums and blogs... different story.

Hehehehe... its not about wether you lose, win, or draw in court. Its about not being able to anonymously behave with license even though you aren't entitled to it. A lot of things are said online by turds that would get their nose broken if it were not for an anonymity that equates to perversion just as much as a peeping tom. Ergo you would never do it because you know its wrong unless you are sure you won't get seen/caught... regardless of wether you suffer in court or not. Being exposed as the dirtbag you are will stop most.

Hey guys, I really don't like rValdez so I figured out who he is IRL and started a smear campaign, I made a website about how he's a child molester and has been for a long time. Every time he moved he did so to avoid being caught. There's lots of proof <insert random, never solved, child molestation cases in the city he lived> for this. It has probably to do with the fact that his father molested him when he was young but it's gone from bad to worse. I think he's a ***got and a ****ing worthless subhuman individual but it is ofcourse up to you whether or not you take me seriously and believe what I say.
I made some flyers and spread them around where he lives with this info and the link to my website, I also sent a mail to the CEO of the company he works for with the title "Just so you know what kind of people you have working for you".
Have fun with that.

Also US laws only apply to the US. And if you want to sue for libel or slander you have to prove you aren't what you are being referred to as beyond a reasonable doubt.

But that's my point, there SHOULD be restrictions to what you can say and do. Freedom of speech comes with responsiblity just as (for instance) gun laws; you're allowed to carry one but if you're an idiot with it you're in trouble.
And I BET that if that smear campaign would be done right and for a longer period of time, people would start to go "if there's smoke, there's fire" and you'll start to get a RL fail cascade. And knowing the amount of sicko, psycho people out there willing to nail someone there HAS to be some sort of control over people spouting 'facts'.

Except when you grow up you're expected to be able to put up with that kind of talk. I wouldn't go sueing every person who ever called me fat, or ever insulted how I looked or tried making fun of me.
There are already laws protecting children from cyber bulling, and that is honestly all that there needs to be.
