Since there seems to be some confusion about what is a pirate and what is not, I volunteer the system I use to categorize corporations in my own notes:
Non-Pirate (NP): - kills noobs/alts only in their alliance territory - kills vets only if on KOS or at war or in fair duel - kills only pirates
Pirates: Scum Level A (SLA) - accepts ore/corp thieves as members Scum Level B (SLB) - kills noobs in .4 camps, griefs Scum Level C (SLC) - kills anybody in 0.0 for fun Scum Level D (SLD) - kills any vet in 0.0 for fun Scum Level E (SLE) - kills only for money
Honor Qualifier: + keeps deals (does not lie) - breaks deals (lies)
In my experience the majority of vet pirates tend to be SLC+. The second-most common type seems to be SLB-.
Note that there are additional criteria involved for a corp to reach SLA. Basically an SLA means they have NO standards, whereas an SLB has shown some kind of standards somehow. SLA implies SLA-. There is no such thing as SLA+ (that would be an SLB). SLDs often call themselves "PvP" corps, but if they kill outside their territory I class them with the pirates.
I consider mercs SLE+ generally because I have no way to know whether I am on their hitlist.
The way this system helps me is that if an A,B,C shows up in the system I will hide, but if it is a D or E I will continue on the assumption they will ignore me or I can buy them off.

If you kill an enemy in a declared war that is completely legitimate and not piracy.
