I'am the creator of the finished project, you can't sell it, but this "creation" belongs to the buyer.

i dont mean to stomp all over your business plan here, but if youre not selling IP, then why would anybody buy? if somebody had a logo made, you could just go and give the logo straight to someone else which would defeat the purpose of having a logo in the first place, as the main intention of a logo is being unique and distinguisible from competitors... _____________________________________________

You misunderstood me... When i sell a logo for example, the logo is the property of the buyer, that's a fact. I stay the creator of the logo, but since it is sold, I can't sell the property of someone else.

That's the way most of European authors' rights apply, there is a distinction between economic rights (all the money related stuff) and the moral rights (being recognized as the true author of the creation).
So yeah, you can buy the right to use what Eosyn made for you, but you can't sell it and/or pretend you've done it.

Yes if you want. But well, i just used a picture as a background... i could have used a texture, but i didn't. I'm not selling or even claiming the creation of this background, i'm selling the whole creation... the composition of the banner and the logowork.

I use sometimes things that other have done, only as background, the rest is what i make myself, so it's not plagia, it's a totally different creation. Websites like deviant art can be of good inspiration and make for very nice backgrounds.
Unless you made that piece on deviantart, you cant bloodywell do that, you cant just go and take someones piece of art which they have uploaded for viewing pleasure, just out of respect for the creator. And if you are going to do this, make sure its labled as stock, if it isnt dont even think for a second you can use another persons art and pass it on as your own. And by looking at the description of this bit of art.. on deviantart, its not labled as stock and it was released as part of an art-pack (Or just a single upload to a gallery, dunno..)
I've dabbled a little myself in the realms of photoshop & other forms of computer generated art (Link here portfolio section) and if someone cropped a piece out of one of those graphic designs ive uploaded there, i would be ****ed. This may all just be me though, but i hold extremely stong views when it comes to this sort of rip of someone elses work.

Its good to take inspiration from other peoples work, but not crop a piece out of it, slap some text & other **** over the top and say its all done by yourself.
