That is, while being succesful pirate in empire doesn't really break any terms of service so doubt the 'succesful piracy' can be used as 'legal' justification, the same terms of service state CCP reserves the right to ban anyone and anytime as they deem fit... and require one to "follow the instructions of authorized personnel while in the EVE Online game world" Who --purely theoretically of course-- would that succesful pirate be, btw? o.O;

What I would suggest are some great wars or something else to keep 'the wheels running' and to generate some thrill and situations where good teamwork would count. If you take that out of the game you kill the soul of EVE and it will end with some boring stuff anybody could better do offline for his/her own. A damaged small cargo-container made nearly my day ( had to check the logs to understand what happened). In that moment I was really pi**ed.
