First of all I think for now CCP should keep the initial release as simple as possible. I believe this for two reasons. First, there will be lots of new issues and bugs that will need to be worked out. Second, while this is a sandbox, you can't just go changing lore whenever you feel like it. By this I mean there are a lot of checkpoints and guards and weapons scanners on stations to prevent anything happening to a capsuleer while outside their pod. Traditionally the capsuleer level of any station is the safest place in new eden.
But there are a lot of people who want to be able to fight with their characters. And if done right this can be fun and add to the game without changing it entirely.
So, I purpose that CCP introduce fighting in steps.
First introduce the ability to get into fist fights. This would take place in the current station as introduced in incarna. (high sec) Maybe add some skills for hand to hand combat. Plus skills for agility, endurance, and running speed. Guards will break up fights before anyone gets beaten to death. They could make the looser go back to their living quarters once they have reached a low health level. Your health level can either regenerate at the same speed that the aggression timer counts down. Or regenerate according to skill level. If you start beating someone up without reason the guards take you home immediately. In this case the innocent player receives medical attention and their health is restored instantly. If you fight you will get bruises. Bruises only last a day or two.
Here is how you make fighting like this interesting. Standard aggression and security status rules apply. Add a new wallet for use in stations. LetÆs call it your "pocket". You must put an amount of your choice into your pocket before leaving your living quarters. If you go to a bar with no isk in your pocket you cannot pay for drinks or anything. You could still transfer isk from player to player of course. Now make an option to pickpocket other players. Once a theft has taken place both players have an aggression timer. There would be skills for how much you can take at one time. Once someone takes from you, you are free to kick their butt and, if you win, get the money back. You cannot pickpocket someone who already has an aggression timer. People who always have bruises are readily identifiable by others. (Assuming the bar theyÆre in is well lit)
Second open up lower levels of the stations where you can get into fights without losing security status. (low sec) And in these areas you can use non lethal weapons. You could also take these weapons from other players instead of taking isk from their pocket. You could have "mods" to add to your characters clothes. Some make you stealthy so you can steal more isk. Others make you more resistant to weapons. Or even carry more weapons. When you lose a fight and get sent home you have to walk through high sec to get back to low sec.
If all goes well CCP will have the OPTION to open up "null sec" levels of stations. For this a loophole will need to be introduced to allow for cloning outside of capsules. I don't count Dust as a reason for EVE characters to be able to be killed outside of their pods. Maybe someone will figure out how the broker does it. In any case, small weapons could be bought and used in these parts of the stations. But you would have to store them down there. Or give them up to guards before returning to the upper levels and to your living quarters. As lore states, capsuleer living quarters are only accessible through the highest levels of stations. You could not live in null sec levels like you can in space. You would have to return to high sec to get back into your ship. Unless of course you have an alt down there that does nothing but sells weapons. 
Each new security level would act like a different system in space. And have new sockets to rent. If you log off in a socket you will return to that socket when you log on again.

Your idea is well thought out and interesting, however I don't think players should ever be able to fight each other in the station.
The fact is, we are capsule pilots. As individuals, we are the richest and most untouchable human beings in EVE's lore. The average player owns multiple large starships and employs several thousand people.
Why would somebody like that ever have a fistfight when they could get a few hundred hired goons to do it for them for the price of a single module?
Hell, a modern day fighter jet like the Typhoon costs about $120 million dollars. I spent about 20 million ISK on my last Taranis with fittings. If you consider those to be roughly analogous pieces of kit, then 1 ISK = about $6.
I'm not rich, as players of my age go, but that conversion rate makes me significantly richer than Bill Gates.

I agree, it sounds unreasonable that pod pilots would fight like that.
Unless they where possesing dust clones, the expendable assault trooper clones. And the fight would be happening in arenas or in low-sec for the thrill; rich people do crazy **** for the pure joy all the time.
Fluff: pod pilots only use these dust clones when in search of life and death thrills as they are unsuited for extended operation and give a rather dull sensation compared to a high grade body.
The first inclusion of Incarna will not include anything like this, but a later expansion hopefully will.

I completely understand. As far as the role play and lore is concerned you're right.
But so many players out there think of nothing but their next kill. At least the pirates I meet think this way. They will kill a shuttle just because. There's no role play in that. Unless their trying to play a homicidal maniac. lol
I think CCP will do one of two things. They will either stick to their guns and not have first person fighting. Or they will give in. I would be happy if they never allowed fighting. I just wanted to put my idea out there encase they did give in. This is about the only way I would be happy with it. I can't imagine them changing it so you can be cloned outside your pod. I sure wouldn't get out if I knew the station was going to be as rough as it is in space.
I think it will be very very easy to ruin incarna if they do have fighting.

Out of pod cloning is going to be introduced in Dust 514.

Out of pod cloning is going to be introduced in Dust 514.
Yeah but they had to do that to make Dust possible. I know they are in the same universe but it changes the core idea of EVE.
