There is actually a lot more that mcdonalds coffee lawsuit story than most know. apparently the drivethru at that mcdonalds had had issues with not putting the lids on all the way, this had happened to the woman many times before coz the lid was not on the coffee tightly, she had made the store manager aware of the issue on numerous occasions, and still the employees were just putting the lids on haphazardly. the day of the spill that caused the suit, apparently she had told the drive thru attendant 3 times to make extra sure the lid was on securely. It wasn't. and when he handed it to her holding it by the lid is spilled all over her.
Actually, it was also an issue with the coffee. Most don't know this but industrial coffee machines like those at McDonalds make coffee that is far hotter than home models. The difference between burning and scalding.

But once you disturb the liquid the bubbles in the liquid all their trapped heat is released and the liquid explodes. In essence the now 100+ degree C liquid spills itself.
But yes McD's have been fined and warned several times about this. This womans case has stayed in peoples minds because of where the burns were and is often used, wrongly, as an example of the publics stupidity.
The compensation was indeed downgraded at a later hearing.
Well, I sort of agree. I mean anyone who put's a beverage in their lap between their legs deserves everything they get. That's why they made cup holders in cars, it wasn't just for spare change.

Dude. All the skin on your meat & two veg just melted. That's way hotter than you'd expect a cup of coffee to be right?

Dude, don't put your cup between your legs for two reasons, first, if it's cold, your junk get's cold and your beverage get's warm. Second, if your beverage is hot, the possibility of spillage and melted wedding tackle abounds.

Technically, Starbucks has had some of the same issues with their coffee being too hot as well.
Be smart, buy a Keurig coffee machine for your home and never pay for it from a drive through.

No, she deserved it for trying to do it in her damned lap. You see, car seats sit at an angle which means your coffee is technically tilted, towards your crotch. Add momentum of trying to move away from the drive through and the coffee moves even further towards your crotch. Having to move your legs to operate pedals and spillage of full beverage is almost unavoidable once the lid is off.
Hence, it may be McDonald's fault the coffee was hot(despite it being labeled as hot coffee), but the spill in her lap was her fault as she chose to place the beverage in her lap.
It's also her fault for not owning a Keurig. Anyone who makes coffee any other way has failed.

My point is no matter how hot the beverage was, the spill was her fault, not McDonald's. They did spill the coffee on her, she did that to herself.
I mean, if I drive my car into a wall at 120 miles per hour, is the injury I sustain from the crash my fault or the car manufacturer for making the car go that fast?
Yes, the coffee was too industrial hot, but it had been that hot for everyone else and not everyone got burned, only those who spilled it on themselves.

Well sure you could, but in the end it comes down to whether or not you can handle claiming personal responsibility for your own actions.
If I spill coffee in my lap, its my fault regardless of how hot it is. To put the blame for it on anyone else is pathetic.
