No, CONCORD doesn't attack, you could throw snowballs at anyone. Infact, I think they rep your shields.

If it were to cost somethink like $1 for 100 snowballs, I could see people actually buying them and having some fun with it. They'd get used up and people would end up buying more later. Good for everyone.
Though, if they do get added in there, I wouldn't be surprised if they ended up being a $1 per ball.

I remember when the snowballs and their launchers were given as limited-use items during the winter of the Empyrean Age expansion (or was it Trinity?). People used them a lot on anyone since they didn't incur Concord's wrath. In fact, someone actually found out that certain bot programs reacted defensively when shot at by snowballs and then ended up having their mining bots being Concordokened every time. Of course, the bot writers then adapted their programs to avoid that. So, incidentally, CCP actually gave us effective bot-hunting launchers.
EDIT:
I happen to have 300 units of Melted Snowballs in my hangar.

Here is a better idea. Allow players to manufacture snowballs out of ice minerals (kept frozen in a cooler) and then have them sold in the NeX market for Aurem.
The only blueprint you need is for cooler to keep it frozen (a little tritanium please). Other than that, players should be given the option to just pat some bits of ice together to make a batch of snowballs. But yeah, launchers would be nice.

Not only that some players, upon being locked and pelted with snowballs, have made the mistake of thinking they were under attack and shooting back... Concord, of course, takes a dim view of this.

Once I was running about in a Vigil during a corp snowball fight, letting a bunch get on my tail then stopping and letting them all hit me at once. Then I saw a rather different explosion, and a message in corp: "You can outrun a snowball but not a cruise missile!"
