It is just about the equivalent of stealing an item and then selling it to somebody. CCP owns the data, and selling PLEX for real money is selling the property of CCP.

Now I'm not a lawyer and don't have the money (or isk) to play in Federal court but maybe somebody else does. I interpret this as meaning that any citizen or permanent resident of Canada is entitled to make any lawful living if they live (or perhaps reside) in a Canadian province. Since CCP conducts business in Canada - ie they take Canadian dollars from a Canadian player which would mean they were bound by the laws of Canada. I don't know much about other countries constitutions, but because the wording in the Charter is so specific "gaining of a livelihood" it may be enforcable. Just a thought.
