They cannot. Also, SISI means that trying things is free.
You simply cannot light a cyno in HS. If you could, JF pilots would have it made.

Someone undocked a super (Nyx?) during Burn Jita. Not much happens. People gape for a while until a GM gets around to moving it to LS. Supers and illegitimate HS capitals (i.e. Caps that weren't built while they could be built in HS or have left since) get introduced into HS on occasion for a number of reasons.
CONCORD only attacks those with a Criminal flag or Outlaws who stray into CONCORD Sov Space.

I was going by the market grouping, but your definition's just as valid. In which case, my post would be amended:
"No Capitals can use Stargates" Which actually makes a handy defining characteristic.
