Is it only 15 minutes you are free to fire on the thief? I'd prefer that to be taken up to 24 hours, it would add a bit more risk to the thief then (not a lot in most cases granted, but still some).

It's actually quite effective already looking at the width and duration of it. It allow the whole corporation of the victim to fire on the thief. Also the timer resets back to 15 minutes if the thief has to fight. 15 minutes is also long enough time to go through some safe spots looking for the thief. It's pretty nice in overall.

I wasn't using that as a analogue to in-game actions, merely to demonstrate that if you started to accept the argument of "It's not a crime because they didn't stop me", then where would it end?

That's good. They tend to raise feelings on people and overrule all rationality. What you ask is a good question. In many times it leads to what life is like.
Another thing what I don't really get is that false delusion that why people should be equal and why the good should have to win anyways? It's another silly little thing that is completely baseless. In real life many times something does hit the fan and you lose. It's nice to have a game where sometimes the good wins and sometimes the bad wins.
Good wins if you use teamwork and/or stop acting retarded while mining. Bad wins in the opposite circumstances. That's nice. Just like life.
It would be a horrible loss if you couldn't do all those things anymore and they were just snapped away. It would remove so many elements which can be both good and bad.

While from a personal standpoint, I would encourage people to fight for the good, from a game balance point of view, I agree with you. It's when game mecanics get messed up and the force for good (e.g. concord) actively helps the bad players (e.g. thieves under the pre-RMR system), that things need fixing. The can-flagging system is a perfectly reasonable way to do that.
The wider question of good vs evil depends a lot on your personal philosophy and beliefs, and is probably not a discussion well-suited for these forums (if only to keep things vaguely on topic!).
