i was mining away quite happily today in tash murkon prime with my apoc , 8 mining laser 2's with 3 mining upgrades 1's fitted and 5 harvester drones and was pulling in a respectable 1156m3 per minute ... 4 long hard months of training so i could make some decent money ...
along comes an industrial ... i think to myself ... no he knows im not a macro .... i have been talking in local ... having only 1 wasp heavy drone on board i think well theres not much chance of me popping the ship so try deplomacy so i let him know im not a macro to which i recieved the message " so ... dont try to defend yourself" 
i was astounded  and didnt beleave what this guy was doing ... in he came and helped himself to a cargo hold full of ore ... i waited for the red flashing of him behing flagged to come up ..... nothing .... away he went
 i hurried back to the station i thought to myself my weapons setup is 4 jumps away by then he would have taken what was mine and been on his way ... all i wanted to do was warn him off .. all i had available to do so were a few wasp drones in my hanger  time for a sting in the tail
i hurried back to the roid field ... he had not yet returned  ... i was releaved ... i waited for about a minute and he had still not returned ... someone said he was in belt 11 so i made orders to jump from where i was to there as my warp engines powered up on my shiny new apoc (which i was keeping safe till i had mined the money to insure it ) in he jumped ... i just managed to abort w3arp jump and targetted him ... one second before lock i launched my drones 
as the drones lept out of the bay they more or less instantaniously recived the attack order and surged forwards into the fray ... tearing down his shields ripping his armor plateing assunder within seconds he just managed to warp out before his ship blew ... i felt good  ... the amount of times before RMR had been brought out that i had been powerless to stop thiefs made me feel very happy ... he was in local chat moaning about how much damage the drones had inflicted on his
then i saw the red flashing light again whats with this guy i was thinking was he coming back thinking i would have rushed off for a hauler ... i launched my drones ... next thing i knew i was being webbed and he was shooting at me .... thats fine i thought in his heavy assault crusier based on the thorax ... concorde would spring to my aid as this guy was the aggressor as i had only attacked him as he was stealing .... i waited no help was comming and i was nearly unarmed ... surely i thought to myself ccp would not have flagged me also for merely defending my property
i was concerned i knew which way the wind was blowing .... my 3 wasp drones tore down his shields and ate half his armor but i knew it was only a matter of time time before he got them and he did ... i was defenceless ... and webbed ... only 1/4 of my shelds had been taken down and i knew if i had some lasers on other than these mining lasers i could hand his head to him on a plate but i had made a mistake ... this all smacked of a gank of the orst kind ... then he started bragging on local .... demanding ransom ... 50m isk ... i only had 5m isk ... i had as i had said b4 only just paid for my apoc .... so i told him i didnt have it and only had 5m isk which was true ... then he dropped my shields and started nibbling at my armor ... soon it was gone... i had to lend the 20m from a corp mate ... all this time the locals were screaming dont pay him dont pay him
what did they care ? were they coming to my aid ... they knew where i was and were letting this happen ... all the time saying how bad and wrong it was... none offered to group or asked if i wanted vengance until this whole sorry episode was over and after i had handed over the money
a sorry story from a broke player who is now 15m isk in dept to a corp mate

on a more serious note ... ccp either repeal the flagging or sort out the gankers so when we defend ourselfs were not flagged so we miners who are not very skilled fighters dont get ganked

Sounds like you got owned...
I want to say join an alliance, and go mine bistot for 15x the income in safe alliance space, but that might not be what you want to do. So... use secure cans?

yep but unfortunatly you cant anchor in 0.7-1.0 so they would have been useless ... he would have just scooped the whole container away ... im more trying to let people know (who didnt already ) what to advoid

There are a few rules of can flagging you need to understand before shooting the ore thief,
The most important of the lot is that once you shot at the ore thief, then the ore thief is free to shoot you back without concord response.
Please don't blame the locals on this one, they can't help you without being ganked by concord, what's happening is between you and the ore thief and no one other than your corpmate/gangmate can help you fight him.
Sorry to hear you got ganked, but EVE is a rough game and there're no safety nets like other more popular games. It's tough to be 15M in debt, but at least you didn't lose your ship and live to mine another day.

A) You shouldve fit more guns and wtfpwned this guy. Hate ore theives.
B) Be happy you actually got to shoot him at all. I got my ore stolen and went after the guy, but in the end I didnt get any kill-rights on him and got concordinated.

if by "address the ore thief issue" you mean stopping people from taking your ore, you're wrong. it was intended to give you the possibility to shoot an ore thief if you think you're stronger. before the flagging the thief was basically untouchable, now it follows the same rules as most things in eve. the strong can take from the weak and the weak must suck it up.

I beleive this so called MercedesBenz also steals ore under the monikers "BMWZ" "Hondaz" and "Aston Martinz" so kill anyone with those names on sight as well.

I recommend saving up some isk and hiring a merc corp to go after this jerk. People who screw with the rules to pvp in high sec vs. targets that cannot defend themselves properly are scum. Nice job with this CCP you completely missed the point once again.

You as a miner had an option, switch to PVP and engage the thief or ignore it.
You chose to switch to PVP setup, engaged and lost. Even though you didn't lose your ship by paying, you lost your temper then lost the fight.
IMHO, it is working as it should, as Keta Min already said. Its just you couldn't deliver on the retaliation aspect.

from what I read, I would have have taken your money then toasted your apoc for boasting. Thats just me though. A word of advice always keep your weapon systems with you and friends nearby.
Maybe next time if you know your going against 1 person put 3 multi specs on and a warp disruptor with some real weapons then surprise the guy. Don't complain because you feel for a trick so many others have fallen for.

The typical stupid thread.
Would the OP know better can flagging mechanisms, he would have either NOT attacked the thief, or attacked in a decent PvP setup.
You cook it, you eat it. Stop to transfer the fault to CCP, EVE rules, third party players, etc... There's plenty of material available to understand EVE's rules & mechanics, starting with these forums.
You don't like them ? Then be coherent and leave the game. Too lazy to bother studying this particular aspect of RMR before acting ? Then you and nobody else is responsable for your ignorance.
The simple fact that you expected that you could attack a player without him to be allowed to defend himself pretty much defines your profile. I would go even further:
Not only you obviously don't understand the game you are playing and can't identify the class of ship you may face, but after a setback solely due to your incompetence, on top you find smart to complain on the boards ?
You don't even seem to realize that all this could have ended worse than it did. There's no such thing like "a sting in the tail". When you do something, do it decently, or don't do it.

I had a run in with him last night in my barge.
He showed up and managed to take about 50 pyro (I had just started mining). I warped back to station and swapped out my Harvesters for Wasps. I went back to the same belt and jetted 1 pyro waiting for him to show up again.
Sure enough he showed up and I did some serious damage to his itty5 before I ran back to station to wait out the 15min.
I think we repeated the above about 3 times. I suspect his itty was full of nano as he could warp before my wasps could take him out but it was damn close a few times.
His tactics were just screaming that he had another ship hidden away and was hoping he could get me before I docked.
The final time he did manage to get me in his Vigilant and tried his ransom demand. Unfortunately he was a little over excited and destroyed my barge before we could discuss amounts.
It hurt losing a bajillion isk barge but it was great fun.
OP: I couldn't see any ganking in your post, just tactics. I want you to get a piece of paper and write out 100 times "I don't have to shoot people who take my ore"
I love the new can flagging. So far I've taken out 2 itty3's, 4 itty5's and gave a Mammoth a nasty fright. Their embarrassment from being taken out by a lowly barge more than makes up for my loss last night.
