In some states it's legal to record with only a single party consent. If the second party is outside your state it doesn't matter as the recording, and thus the laws of the state that the recording is taking place in, is the one that matters. However, depending on the photos and videos crossing state lines, even if digitally, there could be federal laws being broken. Especially if any of the people in said photos / videos are minors. Regardless if they claim to not be minors.
