You can avoid Concord if you're in a fast and agile ship - sometimes.
And it is 'legal' to escape. The tiniest amount of lag or delay on your side and your ship's gone.
A Mega doesn't fall into that group so he'd probably just have lost the ship.
The ship will have been fully insured, and a collector will have been right there too, so he'll have lost only half the equipment.

Where is your proof?
All you can find on the topic from ccp is 'Concord will hunt the offender and he'll get a security hit.'.
Whenever a Dev or GM has been asked about it, they muttered something obscure.
The hardest announcement has been that the offender will have to bear the consequences if he used exploits to get away, including account bans.
Not once have I seen an official state that it was impossible or illegal to get away from Concord.

There are no 0-run BPC left these days.
There was a nice fraps shootage where someone used smartbombs on a tanked BS to blow up a few suspected macrominerships in Jita.
He sat in his pod in well under 2seconds after activating the first SB. Concord dropped out of warp in roughly .8 seconds.

The S&I change made all my 0-run BPC disappear. Those in the hangar, those in the corp hangar and those from cans.

Concord warps in when you launch the missiles, not when they hit.
When your ship is gone, your missiles wont detonate.
