It's been said many times in this thread, but you said yourself you don't want to hear any counters to your argument.
For the record, skill point do matter, but, hear me out, they never matter enough to determine the outcome of a battle.
It is almost entirely down to your tactics as a player and your actions during the fight. This perhaps is the biggest advantage veteran players have, they have greater in-game experience.
After the many losses you have described, you should at the very least begin to get wise to what's going on. As many have said, including yourself, if you don't want to fight, it can be easily avoided.
As for if you do want to fight, 1v1, granted, the veteran does have an advantage skillpoint wise. But as others have stated, not by much. If you have the relevant PvP skills at level 4, a small and worthwhile investment, and the veteran has some, or even all at level 5, sure, he'll have the advantage. Not a huge advantage though.
The skill system was developed with the idea of newer players being able to compete effectivly with older players at it's main focus.
The only time I can really see skill points determining the outcomer of a fight, is where you have a 'true' newb. I.E still in a rookie ship with 60,000sp.
After a few days of training, skillpoints wise your ready to take on the best of them. Granted that early you may not have the in-game knowledge, but EvE's complexity is one of the main factors which makes it awesome. After a few months, or even weeks of training, when you can use some more mods, have some basic tanking skills, and more importantly, can use ECM, you can not only fight back, you have a VERY good chance of coming out on top.
EvE is the only MMORPG I know of where newer players actually have a hope in hell of killing older players. But it's not just a hope in hell, is it? With a bit of thinking and some experience in PVP you don't just have a small, negligible chance to win, you have an amost equal chance to win as your competitor.
I'm starting to ramble now, but to be really honest it annoys me when people start shouting "Change the game, this doesn't work to my advantage!" when you forget that there are others of us playing as well, who like things as they are. Don't fix what isn't broken.
Nothings stopping you, if you wanted to, to fit up a PvP setup, find an NPCing battleship and taking it out. Except the other pilot may have superior tactics and may have the foresight to get to a SS when you enter local, as you should have done yourself.
