There seems to be a huge grey area surrounding the issue of whether using a macro to act exactly as a player when mining is TECHNICALLY against the EULA.
Technically, as people have stated several times, duplicating the actions of a human in this case is not strictly against the letter of the EULA.
HOWEVER (before many people argue) the case in point is (like many things in real life these days) the 'spirit of the law' vs the 'letter of the law'. Is it in the spirit of the EULA to stop people from using a macro TO DUPLICATE THE EXACT ACTIONS THAT A HUMAN WOULD. Not affect the sent/received data, not speed things up but purely to maintain the current flow of play? The EULA states:
"You may not use your own or third-party software to modify any content appearing within the Game environment or change how the Game is played."
However, does a macro duplicating the actions of a human modify the content appearing within the game. It certainly does not change how the game is played, as the game is being played in the same way, just by an AI. Does the EULA state that a human has to be in control of the PC running the game? (If so then my dogs gonna be bummed :D - j/k)
People will argue both sides until they are blue in the face. I would like to have a clear written clarification from CCP on the matter. Unfortunately the EULA CAN be open to interpretation, and many people will often use the letter of the law to circumvent the spirit.
As a side-note..attempting talking to someone to check if they are AFK macro mining is not reliable either. I work with EVE playing in the background and I semi-regularly, although quite often, check my payload when mining, transfer stuff into/from containers but I keep my chat window down (unless I know my corp buddies are online) and ignore incoming hails from people (usually they're just threats or pirates) so I could be mistaken for macro-mining when I don't, (Actually I don't need to - I work from home :D) simply because I don't answer people.

BTW - I vote for implementing the Mine to... option!
