It is my understanding that "trading" GTC's for isk is fine. Those GTC's hold a monetary value. By allowing GTC's to be traded for isk, they have set a value relative to the real world.
Example, CCP sells you 1200 30 day GTC's for $17,940 US. That is face value. They allow you to trade GTC's for isk. They have just allowed real currency to touch Eve currency. A value can now be placed on it.
Regardless of whether you paid for the GTC or traded for it, you allowed in game currency to be valued against real life currency. Unfortunately, CCP opened the door. regardless of whether they operate out of Iceland or not, I can see the US government's position.
Do I think they have a right to tax in game currency? No!
Will they try? probably, based on the above arguments.

Edit: And How can the IRS prove who lives in the USA boundary's and who doesn't, Data Protection Laws will forbid CCP giving out any customers details.
They get Homeland Security to phone CCP & say they have reason to believe US based Al-Qaeda terrorists are using EVE-Online as a training ground for an in space attack on NASA.

Correct, CCP will never have to pay the US Congress anything in terms of Tax, in relation to this story that is. The company CCP might pay taxes on Advertisement etc in America, but this has always been the case and wont effect players in anyway.
The only people I can see been effected by this law are the players living in the US. However, if CCP choose not to enforce the system for taxing its US players then I doubt the US Taxman can do anything, probally just disable US players from playing EVE, which is insane and will never happen.
I highly doubt this bill will pass...

It is probably very simple to get the locations IF THEY REALLY WANTED TOO
Menwith Hill Listening post is a RAF post run by the USAF.
It role in life is to monitor millions of electronic communications per hour and via filters pluck out those that are of possible interest to the UK and USA governements
By Law it is illegal for this USAF post to monitor US citizens in the USA for data collection purposes such as this without a warrant (I believe thats correct for the USA it certainly is for the UK) and the same for the RAF for the British.
However there is nothing stopping the RAF collecting USA data and the USAF collecting the UK data and then swopping  
However would they actually bother for Eve isk tax collection purposes??? I seriously doubt it..

LOL, USAF fit WCS, the small mediumly powerful alliances of Europe band together and begin blob warfare, before god issues the message thet the Atlantic node cant handle anymore and reality crashes :)

I'm a little concerned that the BBC have reported EVE as relying on RL trade. It doesn't or shouldn't Second Life has a real life economy built in. EVE hasn't, its anti-EULA trade.
I'm not sure if its the BBCs fault its been reported in this manner or CCPs. If I was CCP I would be make the BBC ammend that report. Anyone reading that could be excused for thinking exchanging RL money for CCP items is OK.
The fact that hasn't been picked up illustrates to me that the community now thinks its OK and so does CCP.
I love old characters that post 'I've beeen playing the game three years' when I know their account has been sold on.

Just another thing the US are bein D**h***s over God how i would love to type that word here... so there in debt the US just want to tax everything in the world.. really they need to get a grip ,
