My take.
--- In addition to having the skills and money to purchase a ship, the Empire in question should also provide permission for you to purchase such a ship. This is the Permits or License system. Permits and licenses should be connected with your security status within that faction. In order to buy an Apoc, for example, you must have a very high standing with the Amarr; to get a Moa, you need a high standing with the Caldari. To get these standings, the player will be forced to go around the different empires and hunt against different faction pirates.
They can be assigned as follows:
* Industrials do not need Permits or any high standing.
* Frigates do no need any high standing.
* Cruisers need better faction standings, with each level requiring a higher standing than the previous one.
* Battleships require the highest faction standings of all, with Level 2 battleships the highest.
What about pirates? Pirates can't go and get faction battleships anymore. However, they will get their own cruiser and battleship designs.
Pirate battleships and cruisers are either modified designs of faction ships (just as NPC pirate drones uses modded designs of faction ships, like Serpentis with Gallente ships) or new designs like the Sansha and Angels.
BPs and the ships themselves are sold by nefarious NPC corporations who deal illegally with arms trade and supply arms to pirates, private armies and local warlords. Players with good standings with Empire Factions won't be in good standings with black market arms traders, and so they cannot purchase the pirate versions of the ships or the pirate ships themselves.
The pirate versions of faction ships will have a different paint job and even some details will be different. A pirate Maller for example, may be black and red in color, while the Amarr Maller is all gold.
The differences between the Empire ships and the Pirate ships are as follows:
Empire ships should have higher CPU, stronger powergrids, higher cap resources, more powerful shields, more module slots, drone space, higher targeting range, lower energy and cap requirments for all modules.
Pirate ships should have greater armor, more cargo space (for loot), higher speed, faster projectile rate of fire, faster targeting speed, and allow for more missile launchers to be installed.
In a straight fight the pirate ship should lose since they are technologically inferior as they should be. Instead they should rely on their speed and early strike for surprise at the initial blow, then get away. For weapons, they should be more optimized for projectile and missiles to befit their lower tech.
