In this particular case, it probably was just a griefer, since he came back in a ship tough enough to kill you before Concord got him. Just your average carebear who wants the thrill without the risk.
I highly doubt it was anyone on "antimacro patrol". I'm becoming part of that crowd myself. It is very easy to spot a macro and tell the difference between a macro and somebody just mining.
If you're mining ice and notice somebody approaching, say something in local before they do or say anything. Macroers don't start conversations and an antimacroer will leave you be. If you happen to be surrounded by what seems to be macroers, move well away from them or you could get caught in the middle of a suicide gank.
:edit: If someone does steal your ore and they claim to be looking for macros, they usually will give back the ore no problem. MAKE THEM FORM A GANG WITH YOU BEFORE YOU TAKE THE ORE BACK. Otherwise, you're giving them aggression rights and they can gank you without Concord intervention. Leave the gang immediately after taking back your ore/ice. :edit:

Unfortunately, it is. At least that's the impression you'll get if you pay attention to these forums.
Just ignore that sort of thing when someone goes on about it. This isn't WoW where you're supposed to shoot everything that moves.
As for your ore theft problem, there are some solutions, but it requires teamwork between your corpmates.
Have somebody in a hauler sitting right next to your jetcan. Both of you leave the jetcan window open. When someone jets the ore into it, the hauler immediately moves it to the ship's cargo. Don't ever let ore sit in a jetcan, if it can be helped. Impossible to steal without involving gunfire.
You can also have a corpmate in a combat ship who knows how to use it (cruiser is probably best) watching over everything. That will discourage most newb griefers. If someone does steal the ore, gank them. If they talk smack in local, block them. Nothing they whine about is going to be worth reading.
If people are stealing ore elsewhere in the system, set a trap for them. Mine into a can like normal and have your combat ship sitting somewhere in the system. Stick on a 2 point scrambler, a web and a passive targeter on your mining ship. If someone comes near the can, target them passively. If they steal from it, scramble and web it (make damn certain they're flashing red first) and have your combat ship swoop in and gank them.
