You do not understand how the market works. You are not able to pick and choose which Sell Order you wish to buy. It doesn't matter which Sell Order you happened to rclick on and say to buy, when you "buy" an item it will fill that order with the lowest priced Sell Order on the market. The market is not useable as a method to selectively transfer ISK.
I can confirm, some time I have been the surprised seller, even petitioned it fearing it could cause problem as using a bug. GM confirmed that the lowest sell order is the one that get the isk, indipendently by what is the sell order selected.

Out of curiosity, could the OP put a hauling contract up with the 7m as collateral and then have the other guy just never deliver it?
