So there i go again:
It is sad to see the community fighting about ship reimbursment and whos fault and other things like that. It is unproductive and divising.
Instead of blaming others with unfounded theories maybe we should all look at how it "could" be solved.
Strangely *all* capital ship lost tend to be petitioned and we all hardly believe that when one of those goes pop it is never the fault of the fleet/pilot owning it.
So here is a proposition. Keep in mind i do not know anything about computers and nodes or other servers. So what i say could be total nonsense.
Why CCP can't just TOTALLY stop ship reimbursments.
Unless: It is a proven fact that the node/server is actually defectuous/overloaded if there is any ways that they can analyse it. I mean by that not a player proven fact (player winning about is loss) but a technical anylised fact.
Regarding the incident between LV vs Coalition I believe that NONE of both sides should be reimbursed. Why? Following the same above thinking both side did know what would happen (Well known that jita is lagged with 600+) but both side still went for it. One side put the node under stress just by turning up to defend it, the other made it happen by jumping in. And none is to blame.
This mean both sides need to deal with the consenquences.
So in a short sentence:
Stop totally ship reimbursments unless devectious node. Exeption when the node fries even when CCP puts all they can put in a single system and the technology just doesn't follow.
Consequences:
People will think twice before throwing that many ships if they know they just won't get reimbursments. People will be a bit more hesitant to fit billions worth of isk on a silly ship in large gangs, etc etc.
I could be totally out of the loop here and talking nonsense but PLEASE keep this thread related to solutions and no more accusations. Keep those for the hundreds that are already in the forum.

As far as I know this is already the case. The only times that people get reimbursed (not counting bought insurance), is when CCP finds something tangeable wrong with whatever system/node the player was in at the time.

Thats good but it seems that many pilots use the petition tool whenever a ship worth a lot is lost. So it seems there are abuses. But putting a very clear and strict rule (maybe hard one) it could be fixed i guess.
I'm not sure about what i will say but it seems that all megacapital ship loss have been so far petitioned. And also it seems that none had it back. But wouldn't it be good to be on a smaller ship scale too?

If you willing go in to a laggy place such as a pos with 300 ppl at it, you have prety much voidet any right to have it reinbursed afaik

Maybe that's how it is in theory, but "consistency" does not look to be part of the vocabulary of the EVE GM team. Never has been. 
Ever noticed how the same petition can get two opposite answers depending on which GM gets it?

Loads of time, only ever asked to have one ship replaced, and that was when a node did a tripel crash in 20 mins and i got it back

Nope, claim lag or CTD and you get your ship back. Its bloody iratating, I lose a BOAT load of mins cause I refined a can that they were in while the can was open, or something like that, petition... nothing.
Then I loose a arazu + cloak + T2 fitting to a but no showing my criminal timer, get pwned by sentries, petition...
if I had claimed lag on the 2nd, I probably would have got my ship back, cause thats how everyone else I know gets their ships back.
very very irritating.
