Does it? Two words: occupational hazard.
I mine for a living. It's what I do, because I am fortunate enough to be able to mine from work when things are a bit slow or what I am doing is not particularly intense. I've seen all the tricks, and I know most of the ore thieves in my system. If you want to mine in empire, you need to accept that ore thieves are an occupational hazard, and understand the tricks they employ and how to defeat them.
There are two kinds of ore thieves:
1. Want your ore 2. Want to fight
The thieves that want your ore are going to get your ore if you mine into a jet can. Period. If they're good at what they do, and most get good quick, you don't have a chance to save your ore. Generally, they get right to your can, open it, start their warp, and then grab your ore just before their warp begins. If they time it right, by the time you get a lock they are already in warp and gone.
The thieves that stick around after stealing your ore WANT you to fight. They don't care about your ore. They want to pop your barge. They want you to throw a fit. They want to taunt you, and get you mad. If you attack these folks, you're giving them what they want and will likely lose your barge and/or hauler. They often have friends waiting to warp in, so thinking that you can take their frigate is just playing into their hand.
So what to do? In empire, having someone guarding you is pointless. A nice big hauler is much more valuable. If you don't have a secure can to mine into, make sure you only keep a single unit of ore in your jetcan to hold it open. The hauler should work on keeping the can like that all the times.
If an ore thief steals that single unit, then he WANTS YOU TO ENGAGE. Don't do it. Don't even acknowledge him. Just pop a new can and move on. He'll find another more easily manipulated target and move on.
