Ive heard of one case of an ISP's customer (think it was Vigrin ADSL reported on Thinkbroardband forums) using the unfair contract terms act to get a refund out of an ISP that repeatedly underdelivered on service.
Might be worth thinking about if its true and they wont let you out of the contract.

This bit of advice from the OFT would seem to indicate Tiscali dont have a leg to stand on regading their contract. Though you will obviously be in for a fight should you wish to use it.

So basically there using the excuse there are traffic managing you even though they didnt know they were doing it until you told them they were doing it.

ok Tiscali are the biggest pile of **** going, but as far as i am concerned it up to ccp to make a stand against this isp.. (it is blocking there product) and fix this.
CCP dont have a contract with Tiscali you do if you feel so strongly take them to a small claims court. 6 months x subs + 6 months x tiscali fees assuming you been affected.
When they lose they might up the priority on a fix.

OK, what I need now then is something I can quote back to Pipex, please.
I can't get onto the Tiscali forum, and Pipex doesn't have one. Is there any published information (i.e. some quotes from Tiscali or Pipex employees) that I can access? I need to prove to them, out of their own mouths, that it is a fault that they have not fixed.
