I do believe I've gotten ALchemy to work with EvE despite the checking of files in the \bin folder. Here's how:
First, XP SP2 and later searches for DLLs in the programs folder, then in the system folder and after that in the paths specified in the PATH variable. Putting the ALchemy DLLs in the \bin folder or somewhere in the PATH are out of the questing, since eve will not allow them in \bin and windows will find the original ones in the system dir before checking the contents of the PATH variable.
But: It is possible to disable the Safe DLL Search Mode, which when turned off makes Windows check the current directory before checking the system dir. At least that's what I gathered...
1) Turning off Safe DLL Search Mode
Start Regedit as admin. Go to "HKLM\System\CurrentControlSet\Control\Session Manager\" and create a new DWORD there. Call it "SafeDllSearchMode" and assign the value 0 (zero), should be default anyways. Reboot.
2) Create an empty directory somewhere, let's call it "c:\eveAL"
3) Create a new game profile in the ALchemy config utility, specify it's path as "c:\eveAL". Activate it. Now the new directory should contain two files: dsound.dll and dsound.ini
4) Edit your shortcut to EVE. Set it's working directory (right below the path to eve.exe, it's called "Ausfnhren in..." in german) to "c:\eveAL"
This makes c:\eveAL the current directory when launching eve, so Windows checks there after not finding the dsound.dll in eve's bin directory.
Even though one still cannot activate "hardware acceleration" in the escape menu, the ALchemy DLL creates a log in c:\eveAL which indicates it being actually used. Since this special DLL can only use hardware, I'm guessing that's good enough.
Let me know if you got it working that way, I couldn't be bothered to listen for differences right now...

Works perfectly here, and the "Hardware acceleration" checkbox was automatically ticked following the procedure.

Sorry for my language but i am happy. I read your manual and it very hard to do.
I found another very easy way how to do this.
Edit your shortcut to EVE? and go to the "Compatibility" and set Compatibility mode with Xp sp2 :)))) All working with 5.1 and hardware acceleration !!!
Do not need this stupid ALchemy utility.

Yes, thank you Braineater. With this method it does seem to enable ALchemy... and even though the in-game check box is not enabled, the log does suggest it's working. Kudos to this solution! 
And @ KrabKley - Setting compatibility mode to XP SP2 will not work. If you've been using computers for a few years Braineater's solution is not hard to do. And just because you set something to compatibility mode does not mean that all of a sudden the old XP stuff works. Usually compatibility mode is used only when I game won't launch because it detects Vista and says you need to be on XP.

Not alone, no. But combine that with this method and you'll see that the hardware acceleration checkbox seems to work again. Now I just need to figure out how to make Eve think I'm using 5.1 speakers (actually using headphones) so CMSS3D works.

Can at someone and does not work, but at all my friends - yes. Completely works 5.1. Differences in a sound under XP and Vista are not present. The only thing that should be made that has earned 5.1 it in Vista in sound options to include 5.1

Oh i see, That's how to get the checkbox working 
Speaking of CMSS3D: I always loved the stereo surround function I got with drivers on XP, but Creative removed that CMSS3D preset on Vista saying it was due to the architectural changes that you can't get stereo surround on Vista. Well I found some modified drivers for my Audigy 2 that re-instroduce all kinds of settings including bass management, stereo surround, the old-fashioned wave sliders, etc. Check them out, they work for SB 2/ 4 and i think X-Fi. Find them here.
