Is it really Legit?
I mean as a pirate can you just gank anyone you feel like it any time, warp off because concord didn't get you in time. Then have your alt come along and scoop to loot?
I mean isn't this what wardecs are for?
I would think this type of action is what generates a lot of petitions right? Doesn't CCP advertise High Security where Concord will kill whoever attacks an innocent?

No; becoming criminally flagged in high security space then not dying to CONCORD is actually considered an exploit.

I thought Concord followed you around. Beside what difference does that make if you don't get concorded. The poor slob you BBQed doesn't have a hope in hell of getting their stuff back, UNLESS you die.
What about if you setup a Large POS, gank someone and if Concord doesn't show up in time, you manage to warp to the POS in which you can just wait out the timer in the shields.
The ultimate two for one, You gank someone, you get to keep you ship and the guy you gank can petition all he likes CCP is not giving back jack. Griefing just took on a whole new level there.

I find your post a good question. Being one of the Piratical types that choose to properly work under the restrictions of a war dec, I have never questioned the ganking situation.
I can say that in my experience, noone escapes Concord without the use of some crazy exploit.
As far as it being fair or legit to suicide gank, I would have to role play a moment and consider what would happen in the actual universe of Eve. I would think with the ability of cloning, that a person could exercise the suicide gank tactic knowing their mates will grab the loot and run to the clone vat to divy my proper share.
Just thinking outside the box i guess

concord just blows you up anyways.
the only way i can think of doing it is shooting someone and warping off, and landing at a station and docking. although the warp would have to be about a minute long for this to work....

Pirating in high-sec...
1) Find a miner who uses a jet-can... steal his ore, put it in cargo, jettison it out, open your can, move all his stuff from his to yours. Wait for him to attack or take ore back... kill.
2) Find someone ratting in the belts (0.5 systems are best for this). Hurry over to the wrecks of the rats they killed and steal the loot. Wait for them to lock you and attack (ratters do this frequently since they, as opposed to miners in 1) have guns onboard).
3) Have a battleship with sufficient tank and DPS, attack a random ship and try to kill it before Concord arrives on the scene. This is suicide, your ship WILL be destroyed, but you just might get the other guy down before you pop. This works best in the lowest high-sec areas (such as 0.5-0.7) since Concord arrives slightly slower in these systems than they do in the 0.8-1.0 systems.
Other than that... I dunno... I guess if your corp is at war, you can kill the opposing corporation members in high-sec space without Concord interference, but that's not really pirating, but straight warfare.
ALso, alot of people will say the 2 first examples above isn't really pirating... well, I'm not going to contest that argument. But, keep in mind, there is really no other way to get at the Carebears in high-sec. In EVE, you do what is fun to you. If someone else don't like it well... they can play another game then that has rulesets that protect them better than EVE does.

What the hell are you tanking? If you are doing this then its all about damage and more damage, I haven't had a hauler fight me as they are afk and no idea what is happening 
and if that isn't pirating what the hell is it? I am taking from the weak and profiting from it so that's pirating

If Concord is after you and you do not die under ANY circumstances that is an exploit.
However, If you suicide gank and just let concord finish you while your FRIEND picks up the loot you are fine. concord just blows you up anyways.
