The woman charged with disorderly conduct for swearing in her own bathroom was in court Monday in Scranton.
In October, Dawn Herb swore at her toilet when it overflowed. She admits it was loud enough for people outside to hear her. It lead to a citation and then, some help from the American Civil Liberties Union.
An attorney, acting at the request of the ACLU defended Herb's right to free speech. The charge is disorderly conduct but Dawn Herb was polite when she arrived at her hearing in west Scranton.
"Just hopefully this is the first time and the last time I have to come in here. Hopefully, it doesn't get extended, or, I hope the charges just get dropped. That's all I'm looking for," Herb said.
The mother of four is accused of shouting at her overflowing toilet back in October in a profanity-laced tirade that seeped out her second floor window and into the ears of her neighbor, 12-year-old Sydney Gilman.
The young girl testified in court that she told her father, off-duty policeman Patrick Gilman that the woman was cursing.
He testified that he called his colleague, Scranton Patrolman Gerald Tallo, who then wrote Herb a citation.
Herb's attorney, civil rights specialist Barry Dyller, said what his client said may not have been in good taste, but, "We're allowed to swear at each other. It doesn't mean we should but we are allowed to and the government and the law cannot stick its nose into these private matters."
Dyller argued using specific court cases that profane speech is not obscene speech and that what Dawn Herb said and did is not illegal.
If convicted, Herb could spend 90 days in jail and get a fine of up to $300.
The judge said he would take a few days before making a decision on the charge of disorderly conduct.

i mean... "americans" are allowed to carry guns so no oppressive government could ever abuse the people.
but then there are places that have restrictive LAWS ON SEXUAL INTERCOURSE. (and im talking about consentual, between adults)

Could I sue the US for false advertisment proclaiming itself "the land of the free" where people can be brought before a court for swearing at a broken toilet in their own house? Surely a 12 year old should be very familiar with swearing by that age

It's gonna hear those kind fo things anyway, it's up to you as a parent to explain it to them and put it in proper context. Denying your duty to teach your child just that will make you a bad parent, so im glad you dont have any children.

Agreed - but maybe it's an American think. I understood the concepts of most proffanity when I was 9 years old, found out what **** meant when I was 13 in an amusing story that I shall not retell here

This disorderly conduct was more likely a result of a local ordinance. Most localities, even nations have basic obscenity laws. And being a policeman, the plaintiff was probbaly tired of hearing other tirades from the same woman.
Really, go to France? Could I bring my World War II memorbilia and sell it on Ebay with a picture. No. Should I go to England and have a tirade on a cigarette pack and have the neighbors smell it? No. |

I looked it up because Scranton is about 1 hour away from me. After the policeman's daughter told her father about the cussing, the policemen personally asked the defendant to refrain from from more profanities. And she apparently refused the advice from the police officer whom she undoubtedly knew was a LEA.
youre probably right, theres always more to a story than the part the newspapers tell you. originally i freaked out on the story i read some days ago ... about this free speech thingy... wotsitsname.. you guys know the story, ey?

Realy now, we have democracy here in the sense that if people want a ban on smoking in public they get it. In the US you would have lobbyists screaming not to do it because it would hurt their revenue. As for France? Hell, they lost over a hundred thousand young soldiers in the first month of WW2, why does it surprise you that a country BORDERING Germany would surrender it's 40 million population after such a slaughter? Germany outclassed France and the French had enough balls to accept this and fight a gurilla resistance because they couldn't win a direct war.

Every American I've ever met has been really nice, but the country as a whole needs to look inward at it's government and laws and say "WTF?".

1) The French screwed up by pouring their entire defense budget into a large, static defensive line that the Germans simply walked around.
2) That's not really the issue brought up. Both modern France and Germany ban the sale of many German WWII historical items. Stuff like this could never be sold in either country.

Charge wasn't for swearing at the toilet. Charge was for disorderly conduct. If she had been screaming like someone was tearing out her intestines with a rusty fork then no doubt some scared neighbor is going to call the cops. Of course if its a tirade that goes on and on and on then a ****ed off neighbor might call the cops to get her to stop. There are alot of details that are just left out of this.
How many people here have met someone that can go on a really really loud screaming cursing tirade that gets really long and annoying really fast?
The news of course isn't going to provide these details and instead gives us a watered down version.

It's already here. It's called sexual harrassment.
All you anti-american people make me laugh sometimes. You read a story like this then start getting these horrid ideas about the US.
Remember, we're the country that likes to sue! Mcdonalds lost money because some lady decided to put hot coffee between her legs. They didn't tell her to put hot coffee between their legs but it ended up being their fault.
A man breaks into a house and gets shot by the homeowner. He wins a settlement for being shot.
If the penalty for cursing were actually real our jails would be packed to the brim. I personally would be in there for years with the trash that comes out of my mouth sometimes. Hell, our entire military would be in jail.
And smoking was banned in all public places except the bars, bowling alleys (still being fought as it's a place of family), and your own home. So instead of sitting at Denny's for hours smoking we have to step outside every 20 minutes (Big whoopity doo). Atleast our smokes still only cost $3.5
Atleast it hasn't gotten to the point where I look out my window and see the kremlin everywhere with loudspeakers blaring propaganda 24/7. Yes we have our faults but I challenge anyone to find a faultless country. ___________________________

I can say this about alot of country's. In my position I get alot of people from over sea's who come and visit me. Part of our customer service is going to Cuba so we got a visit from them and the group was pretty cool. They even gave me a keychain. My favorite people are the guys from Canon when they come over from China. We spend hours talking about cultures. One of those guys brought me a airport gift of a thousand soldiers statue which I keep at my desk. In fact most of the people I've met from Europe have been really cool on a personal level. ___________________________
