A pirate and an outlaw are two separate things. An outlaw you can shoot freely in both low sec and hi sec, a pirate you may not be able to.
To better explain, to become an outlaw means your sec status is -5.0 to -10.0. A person with a sec status in this range will flash on your screen red and you can shoot this person without fear of a concord response. Both pirates, anti-pirates, mercenaries, and corporations starting a war without declaring it may have people with this sec status.
A pirate usually, but not always, has a sec status of -5.0 to -10.0. The pirate is defined by his actions and not his sec status. So pirates can and do have sec status's from -4.9 all the way into positive sec status. Attacking anyone first with a sec status of -4.9 up into positive sec status in hi sec, concord will respond. In low sec, attacking people with these sec status's first will flag You as an outlaw even if they have a bounty.
Of course you may respond to someone firing on you without penalty no matter if your in low sec or hi sec.
Real world examples:
You are flying in 0.5 to 1.0 space, you see a person with a -4.5 sec status and bounty at a gate. If you shoot this person first you will get a sec hit and Concorded. If this person shoots you first, he will turn flashy red on your screen, be concorded, and you are free to fire on him without being concorded yourself.
You are flying in low sec ( 0.4 to 0.1 ), you see the same guy above, you attack him first, you will become globally flagged as a criminal, your sec status will lower, you will NOT get concorded while staying in low sec but gate/station guns will fire on you until your 15minute global flag runs out. ( Concord does not exist in low sec )
You see a -5.2 anywhere in the eve universe, you can shoot him without any reprocussions.
The only exceptions to not getting concorded by shooting a person in hi sec that is not -5 or below, is if you are at war with their corp or they destroyed your ship at an earlier date and you have killrights.
