The fact of the matter is..;

Police shouldn't be able to be everywhere at the same time. Meanign that if someone steals your ore and then docks. You could persuit him, dock at the same station...go to the station manager and tell the him 'mr X stole my ore'. Since wer eliving in a cuddly fluffy world the station manager will actually say 'ok lets check it out', instead of the more probable line 'not my problem amigo'.
Now im there with my indy full of juicy ore...your ore. You coming running up with the station manager, and acuse me. Isimply state that i mined the ore and i just docked to unload, you however arrived after me and could have seen my filled holds and decided to try and pull a quick scamm (note the amount of time that has gone by and how its not anywhere near 'instant').
You have no proof, ore has no owner, the only owner is the person who has it in his holds at any given moment.
So you might say i should have been busted when i transfered the ore from 'your' can to my hold. Why? It could have been my can! Its just a container it doesnt have any passwords or otherwise personal attributes...its an unprotected, standard, like they make 1 billion every minute type, crap container...
So lets say...
We forget about all that and say that REGARDLESS...i got busted when i transfered the ore...
ok, thats fine...
I warp away to station. Nobody here knows whats going on yet, dump MY ore here, undock and leave for system X...
How will anyone ever find me? How will anyone ever know and be able to actually prove i commited this crime???
You reall think taking from a container should be considered a crime? Maybe i will be floating around in scorp one day and find a few ospreys mining in a belts. Maybe il unleash a couple torpedos and some cruisemissiles and turn them into Caldari blood drops, bonesplinters and various celebrem slices and whatnot?! Maybe il tell the police they stole from MY can when they arrive to ask me why on earht i just blew 2 nubish people to smithereens...

It's the exact same things as what Zombie did, you may not attack in "safe-areas" (empire/within sentry range) without loosing your ship.
