In high-sec if you shoot you will invite a CONCORD reponse, however you can assit your fleet mate with remote modules ( this will flag you to that person with the exception of warfare links); low-sec, just gate guns to contend, 0.0 - do as you please.

As it stands (for the next 6 hours anyway), any person you are not at war with, who is in gang of people who you are at war with cannot shoot you 1st unless they want to say hi to CONCORD (again this is high-sec). You can shoot them, but then of course they can shoot back. In lo-sec, they will just have gate guns to contend, 0.0 they can do what they like.
However, as of 0200 on the 11th June (post EA patch), any perosn you are not at war with joins your enemies fleet, you will not be able to shoot them in high-sec without inviting CONCORD along.

High-sec yes, low-sec you will take a security status hit for "property damage" (same as for destroying a ship that didn't shoot back)
