Situation: me being a militia member kills someone solo in our highsec from the enemy militia. Some unknown guy from my own militia steals the loot while I'm chasing the pod and starts flashing red. Can I shoot him? Or if I do, will I get the same standings penalty that I would get if I normally shoot someone from my own militia?

when you kill someone, the wreck belongs to the person you killed, not to you.
so when that guy took the loot, the person you killed gets killrights on him, not you. -=^=-

Kill Rights are determined by acts of aggression, not looting or loot theft. The victim would have kill rights on the OP (assuming that he didn't fire back) but not on the militia member who looted his wreck.
As far as I know, you can always shoot anyone that steals loot from your wrecks. Exactly, the wreck of the dead militia member, belongs to the dead militia member. Therefore, the dead militia member has 15 minutes to attack anyone who loots his wreck.
The wreck does not belong to the person who killed him, so the victor can do nothing if someone else loots the wreck first.

As far as I know, you can always shoot anyone that steals loot from your wrecks. Basically, if they show up flashy red in your overview, you can shoot them without consequence.
When someone gets their ship destroyed, the wreck that is left over is theirs, not the person that destroyed the ship. Player wrecks do not work like rat wrecks. If I destroy your ship, then JoeyNoobCorp ninjas the loot, you have 15 minutes to track him down and kill him for stealing from your wreck, I however can just sit and watch, seeing as how it was your wreck and not mine that was stolen from.

There are neutral scavengers following most fleets. They pick over the bones, there are risk to such a career though. Finally annoying a pilot can bring swift death.

Welcome to the world of combat.
Many times you simply dont have the time to loot the enemy wrecks, either the fleet needs to move on or you are chasing someone or you are running froms something else.
Personaly i have not been able to loot a single one of my kills in faction wars thusfar since either i have been solo and cant decloack to get the loot before some ship i cant take from the enemy side gets there and loots it (my bomber can kill but it can very rarely stick around after) or the fleet has to move on so no time to loot.
Thats combat for you so if someone takes your the stuff from your kill well i guess get used to it because it will happen often.

I am informed. Aggression flagging is a different mechanic than kill rights. That 15 minutes that you have to track down people who shoot you or steal loot from you is aggression flagging, not kill rights.
