Alright, think about this:
You're a pirate. You and a couple of pirate buddies of yours are camping a gate, when a battleship comes in. You Warp Scramble, Web, and ECM the ship. Essentially, the pilot is a sitting duck for you to take potshots at. Well, he isn't getting away, so why couldn't you shoot a couple missiles (for lack of a better word) at the ship, filled with people. The middle pierces the ship. Your men get off and wtfpwn everyone on the ship.
Ok, you might say, but they have shield which would stop penetration. Well, you could get the ship into structure and then attack it.
Or, you might say, well, you'd have to send your whole ship over to kill everyone aboard. Alright, except for the fact that the ship workers don't have guns. You send some people over with guns and they wipe out everyone aboard the enemy vessel. Or, you could simply hit the ship with some poison missiles (again for lack of a better word), and then tow the ship into a station, where the poison and bodies are extracted any you have a new ship....
So why can't we steal ships?

You can't board ships by killing the crew, but you can steal other ships if you make the capsuleer eject.

Within the fiction, the capsule can also resist nearly all small arms fire and considerable explosive damage. So even if you'd capture the ship, the capsuleer could just open the airlocks and suffocate your boarding parties. Or just close some blast doors in the ship, trapping your boarders inside, and then opening some airlocks. Some ships might be even uncontrollable without the capsule.
Technically, there is an example in EON where some Freedom Fighters tried to capture an Archon. They had infiltrated the ship, released poisonous gas, and then boarded it. They ended dead, though.
However, as a pirate, you do have a way to capture the ship - just tell the target to eject and leave alive or die if you're being resisted. The problem is that if the mark is going to lose his ship anyway, there's little incentive to him to give it to you - the pod instawarps, so if he knows what he's doing you won't get the pod in lowsec. (In 0.0 getting the pod with a bubble is possible.) Other piratey options do exist, such as telling him to jettison his cargo, or then just plain old-fashioned ransoming the ship.
Ingame wise it would be just quite open to griefing. Say, it's illegal to capture ships - well, have a suicide gank team gank the ship to the point it can be captured (whatever that is) and then board it. Now, what would CONCORD do? Kill the victim's (now captured) ship? Gee, CONCORD helping suicide gankers. (While structure tank isn't much, with a T2 Damage Control it does still make a difference.)

Boarding an Eve ship would be very hard but not impossible, id imagine you would secure engineering and cut main power at the reactor. next once the commandos had secured the compartment your hacker would come on board and Hack Aura and fool her safety systems into thinking there is a core breach and as such eject the pod.

Or just sit and wait as you constantly hold the ship into submission. The pilot will eventually admit defeat and leave his vessel, and letting one of your budding pilots board it for yourself. The problem is however is the pilot going to be so willing? If not why dont you hold them to ransom, negociating a deal to let him go, or have his ship destroyed? Either wya your in control. do something about it !?

however if ROckstar and CCP joined forces and made a Grand Theft Auto: New Eden you all know you would play it. with concord chasing after you when you killed enough miners..... pull into a station repaint the ship...

I've always thought that there should be a way of boarding ships.
Possibly make it so the "troop decks" are modules that fit in low slots and can be filled with marines or something. and high slot weapons such as boarding tractor beams/grappling torpedoes and such.
If the boarding party are wearing sealed zero-g armoured suits nerves gas or whatever wont really be a problem. The only tricky part would be getting the previous capsuleer out of the ship. But i'm sure some kind of industrial cutting laser would suffice for that purpose or as been stated before hacking the ships computer and ejecting the current pod.

The person launches there Shield penetrating Marines/Mercs and next thing you know those inf crack the computer code to trigger pod ejection. They then program the ships to warp to the nearest station and dock.
